BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article 42A.751, Code of Criminal Procedure, is | ||
amended by adding Subsection (b-1) to read as follows: | ||
(b-1) Notwithstanding Subsection (b), the judge may not | ||
issue a warrant for a violation of a condition of community | ||
supervision solely because the results of a drug test taken by the | ||
defendant indicated that tetrahydrocannabinol or cannabidiol was | ||
present in the body of the defendant. | ||
SECTION 2. This Act takes effect September 1, 2021. |
