A BILL TO BE ENTITLED
 
AN ACT
  relating to a study of and report on public and private after-school
  programs.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter Z, Chapter 29, Education Code, is
  amended by adding Section 29.9181 to read as follows:
         Sec. 29.9181.  STUDY OF AND REPORT ON PUBLIC AND PRIVATE
  AFTER-SCHOOL PROGRAMS. (a) In this section, "after-school
  program" means a program designed to provide care for and education
  enhancement to school-age children during a period immediately
  following the end of the school day.
         (b)  The agency shall conduct a study of public and private
  after-school programs in this state to determine:
               (1)  the number of children served by a public or
  private after-school program;
               (2)  the number and location of children who could
  benefit from but are not served by an after-school program;
               (3)  federal, state, and local funding sources and
  amounts that currently support after-school programs;
               (4)  the extent of any effect of after-school programs
  on reducing the dropout rate and improving academic performance;
  and
               (5)  the best practices for after-school programs to
  achieve a reduction in the dropout rate and improvement in academic
  performance.
         (c)  Not later than December 1, 2012, the agency shall submit
  to the governor, the lieutenant governor, the speaker of the house
  of representatives, and the presiding officer of each legislative
  standing committee with primary jurisdiction over primary and
  secondary education a written report that contains the results of
  the study under Subsection (b).
         (d)  This section expires December 31, 2012.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
