| relating to contracts between advanced practice registered nurses | ||
| and health maintenance organizations, preferred provider benefit | ||
| plans or other insurers. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter I, Chapter 843, Insurance Code, is | ||
| amended by adding Section 843.3116 to read as follows: | ||
| Sec. 843.3116. CONTRACTS WITH ADVANCED PRACTICE REGISTERED | ||
| NURSES. An advanced practice registered nurse whose services are | ||
| provided within the limits of their knowledge, skills and training | ||
| pursuant to a contract with a health maintenance organization is | ||
| not subject to the requirements in Chapter 157 of the Occupations | ||
| Code. | ||
| SECTION 2. Chapter 1301, Insurance Code, is amended by | ||
| adding Section 1301.070 to read as follows: | ||
| Section 1301.070 CONTRACTS WITH ADVANCED PRACTICE | ||
| REGISTERED NURSES. An advanced practice registered nurse whose | ||
| services are provided within the limits of their knowledge, skills | ||
| and training pursuant to a contract with a preferred provider is not | ||
| subject to the requirements in Chapter 157 of the Occupations Code. | ||
| SECTION 3. Section 1451.106, Subchapter E, Chapter 1451, | ||
| Insurance Code, is amended to read as follows: | ||
| Sec. 1451.106. SELECTION OF ADVANCED PRACTICE NURSE. An | ||
| insured may select an advanced practice nurse to provide the | ||
| services scheduled in the health insurance policy that are within | ||
| the scope of the nurse's license. An advanced practice registered | ||
| nurse whose services are provided within the limits of their | ||
| knowledge, skills and training is not subject to the requirements | ||
| in Chapter 157 of the Occupations Code. | ||
| SECTION 4. Sections 843.3116 and 1451.2066, Insurance Code, | ||
| as added by this Act, apply only to a contract entered into or | ||
| renewed on or after the effective date of this Act. A contract | ||
| entered into or renewed before the effective date of this Act is | ||
| governed by the law in effect immediately before the effective date | ||
| of this Act, and that law is continued in effect for that purpose. | ||
| SECTION 5. This Act takes effect September 1, 2011. | ||
