relating to allowing the governing bodies of certain political | ||
subdivisions to call for a local option election relating to the | ||
sale of alcoholic beverages. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 501, Election Code, is | ||
amended by adding Section 501.0211 to read as follows: | ||
Sec. 501.0211. ELECTION CALLED BY GOVERNING BODY OF | ||
POLITICAL SUBDIVISION. (a) The commissioners court of a county | ||
may, on the commissioners court's own motion, order a local option | ||
election in the county or a justice precinct in the county to | ||
determine whether the sale of alcoholic beverages of one or more of | ||
the various types and alcoholic contents shall be prohibited or | ||
legalized in the county or the justice precinct. | ||
(b) The governing body of a municipality may, by resolution, | ||
order a local option election to be held in the municipality to | ||
determine whether the sale of alcoholic beverages of one or more of | ||
the various types and alcoholic contents shall be prohibited or | ||
legalized in the municipality. | ||
SECTION 2. This Act takes effect September 1, 2021. |
