relating to the practice of barbering and cosmetology at an | ||
establishment at a public secondary school. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter H, Chapter 1603. Occupations Code, is | ||
amended by adding Section 1603.359 to read as follows: | ||
Sec. 1603.359. PRACTICE OF BARBERING AND COSMETOLOGY AT | ||
ESTABLISHMENT AT PUBLIC SECONDARY SCHOOL. (a) A public secondary | ||
school licensed under Subchapter E-3 may: | ||
(1) obtain an establishment license under Subchapter | ||
E-2 to operate the establishment on the same campus as the school | ||
without complying with the requirement of Section 1603.358; and | ||
(2) employ at the school or establishment a person | ||
holding a license under Subchapter E-1 to perform only the | ||
practices of barbering or cosmetology for which the person is | ||
licensed notwithstanding Section 1603.353. | ||
(b) A student permit holder enrolled in a public secondary | ||
school may be employed or practice barbering or cosmetology at an | ||
establishment licensed at the school. | ||
(c) An establishment operated on the same campus as a public | ||
secondary school is subject to Section 1603.2314. A violation of | ||
that section may result in revocation or suspension of both the | ||
establishment and school licenses. | ||
(d) The commission shall adopt rules for a public secondary | ||
school that operates an establishment and a school on the same | ||
campus, including rules establishing standards for a license or | ||
permit holder who practices barbering or cosmetology at the | ||
establishment or school. | ||
SECTION 2. This Act takes effect January 1, 2024. |
