A BILL TO BE ENTITLED
 
AN ACT
  relating to the confidentiality of certain licensing and employment
  records submitted to the Texas Commission on Law Enforcement or
  maintained by a law enforcement agency.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  S
  ection 1701.454(a), Occupations Code, is
  amended to read as follows:
         (a)  All information submitted to the commission under this
  subchapter, including a copy of that information retained by the
  submitting law enforcement agency, is confidential and is not
  subject to disclosure under Chapter 552, Government Code, unless
  the person resigned or was terminated due to substantiated
  incidents of excessive force or violations of the law other than
  traffic offenses.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
