| relating to the confidentiality of certain employment records | ||
| submitted to the Texas Commission on Law Enforcement or maintained | ||
| by a law enforcement agency. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 1701.454(a), Occupations Code, is | ||
| amended to read as follows: | ||
| (a) All information submitted to the commission under this | ||
| subchapter, including a copy of that information retained by the | ||
| submitting law enforcement agency, is confidential and is not | ||
| subject to disclosure under Chapter 552, Government Code, unless | ||
| the person resigned or was terminated due to substantiated | ||
| incidents of excessive force or violations of the law other than | ||
| traffic offenses. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
