BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. The heading to Section 281.094, Health and | ||
Safety Code, is amended to read as follows: | ||

HOSPITAL DISTRICT. | ||
SECTION 2. Section 281.094(a), Health and Safety Code, is | ||
amended to read as follows: | ||
(a) The [ |

District may use funds made available to the district from any | ||
source [ |
||
for residents of the district, including public health services, | ||
mental health and intellectual disability [ |
||
services, emergency medical services, health services provided to | ||
persons confined in jail facilities, and for other health related | ||
purposes if: | ||
(1) the board determines the district has funds | ||
available that are in addition to the funds necessary to satisfy the | ||
district's obligation to fund indigent health care for residents of | ||
the district; and | ||
(2) the Nueces County Commissioners Court approves of | ||
the board's use of the funds. | ||
SECTION 3. Section 298C.004, Health and Safety Code, as | ||
added by Chapter 694 (S.B. 2315), Acts of the 86th Legislature, | ||
Regular Session, 2019, is repealed. | ||
SECTION 4. Section 2, Chapter 694 (S.B. 2315), Acts of the | ||
86th Legislature, Regular Session, 2019, is repealed. | ||
SECTION 5. To the extent of any conflict, this Act prevails | ||
over another Act of the 87th Legislature, Regular Session, 2021, | ||
relating to nonsubstantive additions to and corrections in enacted | ||
codes. | ||
SECTION 6. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2021. |
