To whom was referred a Bill (S. 380) to amend Section 15-78-60, South Carolina Code of Laws, 1976, relating to exceptions to waiver of immunity, so as to include emergency medical, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

The Committee on Judiciary proposed the following amendment (JUD0380.002):

Amend the bill, as and if amended, page 1, by striking lines 23-24, in Section 15-78-60(6), as contained in SECTION 1, and inserting therein the following:

/    failure to provide or the method of providing emergency response services, including, but not limited to, EMS, police    /

Renumber sections to conform.

Amend title to conform.

EXPLANATION OF IMPACT:

State Budget and Control Board

The board reports there is no impact to the Insurance Reserve Fund with the adoption of this Bill.

LOCAL GOVERNMENT IMPACT:

The State Budget Division surveyed local governments to access the impact of this bill. One county reported there was no fiscal impact.

A BILL

TO AMEND SECTION 15-78-60, SOUTH CAROLINA CODE OF LAWS, 1976, RELATING TO EXCEPTIONS TO WAIVER OF IMMUNITY, SO AS TO INCLUDE EMERGENCY MEDICAL SERVICES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 15-78-60(6) of the 1976 Code is amended to read:

"(6)    civil disobedience, riot, insurrection, or rebellion or the failure to provide or the method of providing emergency services, including, but not limited to, emergency medical services, police or fire protection;"

SECTION    2.    This act takes effect upon approval by the Governor.
