AN ACT
1Amending Title 53 (Municipalities Generally) of the Pennsylvania
2Consolidated Statutes, providing for use of public funds for
3abortion.
4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:
6Section 1. Title 53 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:
8§ 303. Use of public funds for abortion.
9(a) General rule.--No municipality, regardless of
10classification, may use public funds, whether derived from
11Federal, State or local sources, to arrange or pay for abortions
12unless in strict compliance with the provisions of 18 Pa.C.S. §
133215 (relating to publicly owned facilities; public officials
14and public funds).
15(b) Preemption.--The provisions of 18 Pa.C.S. Ch. 32
16(relating to abortion) contain the public policy of this
17Commonwealth regarding abortions and shall preempt and supersede
18any local ordinance or rule concerning the subject matter.
1Section 2. This act shall take effect in 60 days.
