| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in education empowerment, further |
6 | providing for mandate waiver program and for expiration. | <-- |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 1716-B of the act of March 10, 1949 (P.L. | <-- |
10 | 30, No.14), known as the Public School Code of 1949, added May |
11 | 10, 2000 (P.L.44, No.16), is repealed: |
12 | Section 1. Section 1714-B of the act of March 10, 1949 | <-- |
13 | (P.L.30, No.14), known as the Public School Code of 1949, is |
14 | amended by adding a subsection to read: |
15 | Section 1714-B. Mandate Waiver Program.--* * * |
16 | (d.1) (1) The department may grant a waiver of section 751 |
17 | where the school district indicates in its application that it |
18 | intends to solicit multiple prime and single prime construction |
19 | bids and award the contract to the lowest responsible bidder. |

1 | (2) Failure to solicit multiple prime and single prime |
2 | construction bids and award the contract to the lowest |
3 | responsible bidder shall result in the revocation of the waiver. |
4 | (3) Notwithstanding subsection (d), failure by the |
5 | department to act within the prescribed time period shall not |
6 | constitute an approval of a waiver of section 751. |

8 | Section 2. Section 1716-B of the act, added May 10, 2000 |
9 | (P.L.44, No.16), is amended to read: |
10 | [Section 1716-B. Expiration.--[This] Except for sections | <-- |

12 | June 30, 2010.] | <-- |
