AN ACT

Authorizing the Department of General Services, with the

2

approval of the Governor and the Department of Military and

3

Veterans Affairs, to grant and convey to Waynesburg

4

University certain lands situate in the Borough of

5

Waynesburg, Greene County.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Conveyance to Waynesburg University.

9

The Department of General Services, with the approval of the

10

Governor and the Department of Military and Veterans Affairs, is

11

hereby authorized on behalf of the Commonwealth of Pennsylvania

12

to grant and convey to Waynesburg University the following tract

13

of land together with any buildings, structures or improvements

14

thereon, situate in the Borough of Waynesburg, Greene County for

15

$170,000 and under terms and conditions to be established in an

16

agreement of sale.

Section 2.  Description.

The property to be conveyed pursuant to Section 1 consists of

19

approximately 0.22-acres of land and an armory building, bounded

20

and more particularly described as follows:

ALL THAT CERTAIN tract of land situate in the Borough of

2

Waynesburg, Greene County more particularly bounded and

3

described as follows:

BEGINNING at the northwesterly corner of Washington Street

5

and Strawberry Alley; thence along the Westerly line of

6

Washington Street, North 1 degree 0 minutes East 80 feet to line

7

of land now or late of J.W. Ray, et al; thence Westwardly at

8

right angles to Washington Street, along said Ray line and line

9

of lands now or late of T.R. Huffman and M.R. Travis, 120 feet

10

to line of land now or late of T.R. Huffman; thence Southwardly

11

along said Huffman line, parallel with Washington Street, 80

12

feet to the Northerly line of Strawberry Alley; thence

13

Eastwardly along the Northerly line of Strawberry Alley, 120

14

feet to Washington Street, at the place of BEGINNING.

BEING Tax Parcel No. 2604-120.

BEING the same premises conveyed from J.B. Pollock and Alice

17

T. Pollock, his wife, C.H. Bowlby and Eva K. Bowlby, his wife

18

and T. Riley Huffman and Bertha H. Huffman to the Commonwealth

19

of Pennsylvania, by deed dated October 11, 1913 and recorded

20

October 14, 1913, in the Recorder of Deeds Office for Greene

21

County, Pennsylvania in Deed Book 231, Page 547.

Section 3.  Conditions.

The conveyance shall be made under and subject to all lawful

24

and enforceable easements, servitudes and rights of others,

25

including but not confined to streets, roadways and rights of

26

any telephone, telegraph, water, electric, gas or pipeline

27

companies, as well as under and subject to any lawful and

28

enforceable estates or tenancies vested in third persons

29

appearing of record, for any portion of the land or improvements

30

erected thereon.

Section 4.  Additional conditions.

Any conveyance authorized under this act shall be made under

3

and subject to the condition, which shall be contained in the

4

deed of conveyance, that no portion of the property conveyed

5

shall be used as a licensed facility, as defined in 4 Pa.C.S. §

6

1103 (relating to definitions), or any other similar type of

7

facility authorized under State law. The condition shall be a

8

covenant running with the land and shall be binding upon the

9

Grantee, its successors and assigns. Should the Grantee, its

10

successors or assigns, permit any portion of the property

11

authorized to be conveyed in this act to be used in violation of

12

this subsection, the title shall immediately revert to and

13

revest in the Grantor.

Section 5.  Special warranty deed.

15

The deed of conveyance shall be by Special Warranty Deed and

16

shall be executed by the Secretary of General Services in the

17

name of the Commonwealth of Pennsylvania.

18

Section 6.  Costs and fees.

19

Costs and fees incidental to this conveyance shall be borne

20

by the Grantee.

Section 7.  Proceeds.

22

The proceeds from the sale shall be deposited in the State

23

Treasury Armory Fund.

24

Section 8.  Time limitation.

25

In the event that an agreement of sale between the parties is

26

not executed within one year of the effective date of this act,

27

the property may be disposed of in accordance with section 2405-

28

A of the act of April 9, 1929 (P.L.177, No.175), known as The

29

Administrative Code of 1929.

Section 9.  Effective date.
