| AN ACT |
| |
1 | Amending the act of November 10, 1999 (P.L.491, No.45), entitled |
2 | "An act establishing a uniform construction code; imposing |
3 | powers and duties on municipalities and the Department of |
4 | Labor and Industry; providing for enforcement; imposing |
5 | penalties; and making repeals," further providing for |
6 | applicability of act to swimming pools and spas. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 104(f) of the act of November 10, 1999 |
10 | (P.L.491, No.45), known as the Pennsylvania Construction Code |
11 | Act, is amended to read: |
12 | Section 104. Application. |
13 | * * * |
14 | (f) Application to swimming pools and spas.-- |
15 | (1) The provisions of this act as they relate to |
16 | swimming pools and spas shall not be applicable to those |
17 | constructed or installed prior to the effective date of this |
18 | act. |
19 | (2) All swimming pools and spas constructed or installed |

1 | after the effective date of this act shall be governed by the |
2 | requirements of this act, including section 503. |
3 | (3) A swimming pool or spa subject to paragraph (2) may |
4 | not be filled with water until the barrier requirements of |
5 | this act are met and during construction of a swimming pool, |
6 | temporary barriers shall be erected as required by department |
7 | regulations. |
8 | Section 2. This act shall take effect in 60 days. |
