| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, in discipline, removal |
3 | and retirement of judicial officers, further prohibiting |
4 | magisterial district judges serving as arbitrators. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 3304 of Title 42 of the Pennsylvania |
8 | Consolidated Statutes is amended to read: |
9 | § 3304. Acting as collection agent or paid arbitrator |
10 | prohibited. |
11 | (a) Collection agent.--No judge or magisterial district |
12 | judge shall act as agent for a person in the collection of a |
13 | claim or judgment for money. |
14 | (b) Arbitrator.--[No] Except as provided in subsection (c), |
15 | no judge or magisterial district judge shall receive any fee or |
16 | emolument for performing the duties of an arbitrator. |
17 | (c) Arbitrator exception.--Except as may otherwise be |
18 | provided by general rule, the prohibition contained in |

1 | subsection (b) shall not apply to a magisterial district judge |
2 | serving as an arbitrator of any matter that cannot be properly |
3 | commenced in the magisterial district judge's magisterial |
4 | district. |
5 | Section 2. This act shall take effect in 60 days. |
