| AN ACT |
| |
1 | Establishing a time frame for public review on proposed budgets. |
2 | The General Assembly of the Commonwealth of Pennsylvania |
3 | finds and declares as follows: |
4 | Public participation in the legislative process improves the |
5 | quality of proposed legislation by allowing the opportunity for |
6 | its detailed review by interested parties. |
7 | The opportunity for a detailed review by the public prior to |
8 | votes on legislation helps increase public trust in government |
9 | and enhances respect for the General Assembly by ensuring that |
10 | its operation is conducted with the openness, order and dignity |
11 | befitting the Commonwealth of Pennsylvania. |
12 | The General Assembly of the Commonwealth of Pennsylvania |
13 | hereby enacts as follows: |
14 | Section 1. Short title. |
15 | This act shall be known and may be cited as the Five-Day |
16 | Budget Review Act. |
17 | Section 2. Definitions. |

1 | The following words and phrases when used in this act shall |
2 | have the meanings given to them in this section unless the |
3 | context clearly indicates otherwise: |
4 | "Appropriations bill." Any legislation that authorizes an |
5 | expenditure of Commonwealth funds. |
6 | "Five-day waiting period." A period of five consecutive days |
7 | excluding Saturdays, Sundays and State holidays except when the |
8 | legislative body considering the bill is in session on such a |
9 | day. |
10 | "Revenue bill." Any legislation that intends to generate |
11 | revenue for State operating, capital or transportation expenses. |
12 | Section 3. Five-day waiting period required. |
13 | (a) Appropriations and revenue bills.--No appropriations |
14 | bill or revenue bill shall be given a final vote in either House |
15 | of the General Assembly until the version of the bill to be |
16 | voted upon has been made available on the General Assembly's |
17 | publicly accessible Internet website for a five-day waiting |
18 | period. |
19 | (b) Amendments.--No amendment to an appropriations bill or |
20 | to a revenue bill and no amendment that would cause legislation |
21 | to have the effect of an appropriations bill or revenue bill |
22 | shall be voted upon until the amendment has been made available |
23 | on the General Assembly's publicly accessible Internet website |
24 | for a five-day waiting period. |
25 | (c) Reports of committees of conference.--No report of a |
26 | committee of conference that authorizes an expenditure of |
27 | Commonwealth funds or that intends to generate revenue for State |
28 | expenses shall be voted upon until the report has been made |
29 | available on the General Assembly's publicly accessible Internet |
30 | website for a five-day waiting period. |

1 | Section 4. Exemption. |
2 | The waiting period and public posting requirements of this |
3 | act shall be waived upon a two-thirds vote of the legislative |
4 | body considering the appropriations bill, revenue bill, |
5 | amendment, or conference committee report. For bills adopted |
6 | utilizing this exemption, the following section shall be added |
7 | to the text of the bill: The (insert legislative body) has |
8 | waived the people's right for a detailed review of this bill as |
9 | required by the Five-Day Budget Review Act. |
10 | Section 5. Effective date. |
11 | This act shall take effect in 60 days. |
