AN ACT

Amending Titles 42 (Judiciary and Judicial Procedure) and 75

2

(Vehicles) of the Pennsylvania Consolidated Statutes, further

3

providing for Commonwealth portion of fines; and creating the

4

Assigned Vehicle and Equipment Upgrade Account.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

Section 1.  Section 3571(b)(2) of Title 42 of the

8

Pennsylvania Consolidated Statutes is amended to read:

9

§ 3571.  Commonwealth portion of fines, etc.

(b)  Vehicle offenses.--

(2)  (i)  Except as provided in paragraph (4), when

14

prosecution under any other provision of Title 75 (relating

15

to vehicles) is the result of State Police action, all fines,

16

forfeited recognizances and other forfeitures imposed, lost

or forfeited shall be payable to the Commonwealth, for credit

2

to the Motor License Fund. One-half of the revenue shall be

3

paid to municipalities as designated in subparagraph (ii) in

4

the same ratio provided in section 4 of the act of June 1,

5

1956 (P.L.1944, No.655), relating to partial allocation of

6

liquid fuels and fuel use tax proceeds.

7

(ii)  Only municipalities that provide local police

8

services through a municipal police department,

9

participation in a regional police department or

10

contracts with other municipal or regional police for

11

police services may receive revenue under subparagraph

12

(i).

(iii)  When one-half of the revenue under

14

subparagraph (i) is not payable to a municipality because

15

the municipality does not meet the qualifications of

16

subparagraph (ii), that amount shall be placed into a

17

restricted receipts account within the Motor License Fund

18

and designated as the Assigned Vehicle and Equipment

19

Upgrade Account. Funds in the Assigned Vehicle and

20

Equipment Upgrade Account shall be annually appropriated

21

to the Pennsylvania State Police for the purpose of

22

providing assigned vehicles to State troopers and

23

upgrading equipment as necessary.

Section 2.  Section 9511 of Title 75 is amended by adding a

26

subsection to read:

§ 9511.  Allocation of proceeds.

(b.1)  Assigned Vehicle and Equipment Upgrade Account.--The

30

amount of revenue received under 42 Pa.C.S. § 3571(b)(2)(iii)

(relating to Commonwealth portion of fines, etc.) shall be

2

deposited in the Assigned Vehicle and Equipment Upgrade Account

3

within the Motor License Fund, which account is hereby created.

4

The funds deposited in the Assigned Vehicle and Equipment

5

Upgrade Account are hereby annually appropriated out of the

6

account to the Pennsylvania State Police for the purpose of

7

providing assigned vehicles to State troopers and upgrading

8

equipment as necessary.

Section 3.  This act shall take effect in 60 days.
