AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, providing for the establishment of standards for

3

emergency towing and for towing rotation lists.

4

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 75 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 3352.1.  Emergency towing and towing rotation lists.

9

(a)  Definitions.--As used in this section, the following

10

words and phrases shall have the meanings given to them in this

11

subsection unless the context clearly indicates otherwise:

12

"Accident scene."  A scene in which a motor vehicle has

13

collided with another motor vehicle or object, thus rendering

14

the vehicle or vehicles disabled.

15

"Authority."  A person required to maintain and implement a

16

rotation list of towing companies within its jurisdiction, which

17

shall include an individual barracks of the Pennsylvania State

18

Police, municipal police and a parking authority.

"Disabled vehicle."  A motor vehicle which has been damaged

2

or rendered inoperative as the result of wear and tear,

3

mechanical failure or accident.

4

"Emergency."  An accident scene that is dire and impedes the

5

flow of traffic.

6

"Failure to respond."  The failure of a towing company to

7

answer its 24-hour telephone contact number when called by an

8

authority, unless the towing company has provided an authority

9

with prior notice of its inability to receive a call.

10

"Rotation list."  A fair, balanced and equitable list of all

11

towing companies within an authority's jurisdiction that have

12

applied to an authority as provided for in subsection (b).

13

"Satellite station."  A facility operated by a towing company

14

that is in addition to its primary facility, in the same

15

location as the primary facility or in another location.

16

"Towing."  The moving, removing or recovery of a motor

17

vehicle or other debris at an accident scene, the scene of a

18

disabled vehicle or the scene of an emergency.

19

"Towing company."  Any person offering towing services that

20

is located within this Commonwealth.

21

"Towing storage facility."  The location where a motor

22

vehicle has been towed and is securely stored pursuant to an

23

agreement with the towing company that has towed the vehicle.

24

"Wrecker."  A motor vehicle designed or constructed and used

25

for the towing of abandoned or disabled vehicles.

26

(b)  Establishment of rotation lists.--

27

(1)  All authorities within this Commonwealth which

28

contain two or more towing companies in their jurisdiction

29

shall establish and maintain a rotation list of the towing

30

companies in their respective jurisdictions to contact when

requiring towing services. A municipality which establishes

2

and maintains a formal contract with a towing company

3

pertaining to the provision of towing services shall be

4

exempt from establishing and maintaining a rotation list.

5

(2)  When establishing a rotation list, an authority

6

shall receive and review applications from towing companies

7

throughout its jurisdiction. An authority may only allow

8

those towing companies who apply, and who meet and comply

9

with the standards of this section, to be placed on a

10

rotation list.

11

(c)  Rotation list standards.--

12

(1)  Any towing company wishing to be placed on a

13

rotation list must adhere to the following minimum

14

requirements:

15

(i)  Be registered by the department as a

16

miscellaneous motor vehicle business as required by

17

section 1337 (relating to use of "miscellaneous motor

18

vehicle business" registration plates).

19

(ii)  Be regularly open for the conduct of business,

20

receiving of payments and the release of vehicles a

21

minimum of 40 hours per week, and shall be open regularly

22

Monday through Friday between 7 a.m. and 5 p.m.

23

(iii)  Be available and capable to offer towing

24

services to an authority 24 hours per day, seven days per

25

week.

26

(iv)  Maintain a license to collect sales tax.

27

(v)  Carry the types and amounts of insurance to be

28

determined and required through regulations of the

29

department.

30

(vi)  Vehicles and wreckers used by a towing company

for the purpose of a rotation list shall:

2

(A)  Be properly titled and registered with the

3

department.

4

(B)  Have the business name of the towing company

5

listed on both sides of the vehicles or wreckers, as

6

required by section 4573 (relating to identification

7

of certain vehicles).

8

(C)  Be equipped with one or more flashing or

9

revolving yellow lights, as required by section

10

4572(b) (relating to visual signals on authorized

11

vehicles).

12

(D)  Be maintained in safe mechanical condition,

13

and must display current State inspection and

14

registration.

15

(vii)  Provide an authority maintaining a rotation

16

list with:

17

(A)  A general listing of prices or a fee

18

schedule for towing and storage services provided.

19

This fee schedule shall be up-to-date, and when a

20

towing company alters the prices on its fee schedule

21

it shall notify and document the changes to an

22

authority within seven business days.

23

(B)  The name and address of the towing company.

24

(C)  A telephone number at which an authority may

25

contact the towing company at 24 hours per day, seven

26

days per week.

27

(D)  Proof of insurance as required in

28

subparagraph (v).

29

(E)  A complete description of the vehicles and

30

wreckers operated by the towing company to be used

for rotation list towing purposes, including:

2

(I)  Make.

3

(II)  Model.

4

(III)  Year.

5

(IV)  License plate number.

6

(V)  Identification number.

7

(VI)  Engine horsepower.

8

(VII)  Hoist equipment and towing weight

9

capacity.

10

(viii)  Provide the following information to the

11

owner or operator of a vehicle being towed, if the owner

12

or operator is present and capable of receiving that

13

information, otherwise to the owner by first class mail:

14

(A)  The towing company's business name.

15

(B)  The towing company's business telephone

16

number.

17

(C)  The towing company's business and storage

18

facility address and hours of operation.

19

(D)  The towing company's estimated price for

20

towing, storage and related fees that the towing

21

company will be providing to the owner or operator.

22

(E)  The exact location where the vehicle shall

23

be towed, including business name, contact number and

24

address.

25

(ix)  Maintain a secure area, in compliance with

26

Pennsylvania State Police guidelines, that is capable of

27

being locked and that is enclosed on all sides by a

28

barrier not less than six feet in height for the safe

29

storage of motor vehicles and other items that may be

30

necessary to store when providing towing services.

(x)  Post its towing, storage and related service

2

fees as well as its hours of operation at its towing

3

storage facility and at its business office. The

4

department shall determine, through regulation, the size,

5

type and placement of the positioning of this notice.

6

(xi)  Unless otherwise notified by an authority,

7

allow the owner of a vehicle, an insurance company,

8

agency, broker or agent representing the vehicle owner,

9

physical access to his vehicle during posted hours of

10

operation.

11

(xii)  The owner of a vehicle that has been towed and

12

stored in a towing storage facility shall have the right

13

to access and remove necessities from his vehicle, unless

14

an authority otherwise forbids this right.

15

(xiii)  During posted hours of operation, not refuse,

16

unless prohibited by an authority, to release a towed

17

vehicle when the owner of the vehicle, or an authorized

18

representative of the owner, has made payment in full for

19

all towing, storage and related service fees assessed on

20

his vehicle. Payment may be made by cash, a credit card

21

from a common issuer or a check. A towing company shall

22

itemize and put into writing all assessed fees and

23

notification of release, which shall be provided to a

24

vehicle owner or an authorized representative of the

25

vehicle owner upon making payment.

26

(xiv)  No towing company may respond to an accident

27

scene, the scene of a disabled vehicle or the scene of an

28

emergency without first being contacted by an authority,

29

a private person owning space on which a disabled vehicle

30

is located or the owner or operator of a disabled

vehicle.

(2)  An authority may establish additional standards to

3

those established in this subsection for a towing company to

4

meet and comply with in order to be placed on a rotation

5

list. These additional standards shall:

6

(i)  Not supersede or negate the standards

7

established in this subsection and may only work in

8

conjunction with these standards.

9

(ii)  Take into consideration the local circumstances

10

and local geography of an authority's jurisdiction and

11

must always work in the best interest of the towing

12

industry and the consumer.

13

(d)  Unauthorized gratuity, compensation or reward.--No

14

towing company or authority shall provide or receive a gratuity,

15

compensation or reward of any kind for placement or preferential

16

treatment on a rotation list or for towing services incurred

17

through a rotation list.

18

(e)  Maintenance of rotation lists.--

19

(1)  All authorities within this Commonwealth, who are

20

required to do so, shall maintain a fair, balanced and

21

equitable rotation list of the towing companies within their

22

jurisdiction.

23

(2)  Authorities maintaining a rotation list shall

24

establish the list by first cataloging all towing companies,

25

who have applied and been confirmed by the authority as a

26

responsible towing company that complies with the standards

27

of this section.

28

(3)  Rotation lists shall include the name, local

29

dispatch address and 24-hour telephone contact number of each

30

towing company.

(4)  When a towing company is added to an existing

2

rotation list it shall be placed at the bottom of the

3

rotation list.

(5)  A towing company which operates from multiple

5

locations may apply for placement slots, in addition to its

6

primary facility, on a rotation list for its satellite

7

stations. A towing company shall submit a separate

8

application for each satellite station wishing to receive

9

placement on a rotation list. Satellite stations shall meet

10

and comply with the standards of this section in order to

11

receive placement on a rotation list.

12

(f)  Implementation of rotation lists.--

13

(1)  An authority, when requiring towing services, shall

14

implement its rotation list by contacting the towing company

15

at the top of its rotation list.

16

(2)  If the towing company at the top of a rotation list

17

fails to answer its 24-hour telephone contact number or fails

18

to arrive at the scene of a call within a timely manner it

19

shall be moved to the bottom of the rotation list and the

20

next towing company on the rotation list shall move to the

21

top of the list to be contacted.

22

(3)  Upon being contacted by an authority, a towing

23

company shall, in a timely manner, dispatch one of its

24

registered wreckers to proceed to the location where its

25

services are required.

26

(4)  If a towing company is contacted and all of its

27

registered wreckers are in use, the towing company may send

28

an available wrecker from a satellite station to the accident

29

scene, unless the wrecker from the satellite station cannot

30

arrive in a timely manner, the wrecker does not possess the

appropriate equipment for the accident scene or the accident

2

scene requires a hasty removal of vehicles and debris.

3

(5)  Upon arrival at an accident scene, a towing company

4

shall comply with the needs of the authority, owner or

5

operator which contacted it.

6

(6)  After a towing company completes its requirements,

7

an authority shall revise its rotation list by moving the

8

towing company to the bottom of the rotation list, thereby

9

moving all other towing companies one place closer to the top

10

of the list.

11

(g)  Owner's right.--The owner of a vehicle that is being

12

towed maintains the right, unless incapable of doing so or

13

unless an authority prohibits, to dictate the location where his

14

vehicle shall be towed.

15

(h)  Exceptions to a rotation list.--

16

(1)  When the owner or operator of a disabled vehicle

17

selects a qualified towing company to remove his vehicle, the

18

rotation list shall not be implemented or affected.

19

(2)  If an emergency exists, an authority may ignore the

20

preference of a vehicle owner or operator and may deviate

21

from the implementation of a rotation list. In so doing, the

22

authority shall then contact the towing company:

23

(i)  That is located in the closest proximity to the

24

accident scene.

25

(ii)  That is able to respond to the emergency in the

26

fastest manner.

27

(iii)  That possesses the appropriate equipment for

28

the emergency.

29

(3)  When an authority ignores the preference of a

30

vehicle owner or operator, the authority must first inform

the vehicle owner or operator that it is doing so.

(i)  Removal from rotation lists.--

3

(1)  An authority shall provide the towing company with a

4

written list of causes for which the towing company may be

5

removed from the rotation list.

6

(2)  An authority may remove a towing company from a

7

rotation list for just cause. Just cause includes, but is not

8

limited to:

9

(i)  Falsifying information on its application.

10

(ii)  Failing to meet or to comply with any of the

11

standards under this section.

12

(iii)  Conviction of a violation of Federal or State

13

law which is graded a misdemeanor or greater by a towing

14

company or principal thereof.

15

(iv)  Failure to respond or failure to respond in a

16

timely manner on three or more occasions within a 30-day

17

period. The failure of a towing company to respond to a

18

call when all of its vehicles and wreckers are in use is

19

not a violation of this subsection.

20

(3)  Removal of a towing company from a rotation list

21

shall be for the following durations when violations of this

22

subsection occur within the span of 12 consecutive months:

23

(i)  Two weeks for the first violation.

24

(ii)  One month for the second violation.

25

(iii)  Six months for the third violation.

26

(iv)  One year for the fourth violation.

27

(v)  Permanent removal from a rotation list for five

28

or more violations within the span of 12 consecutive

29

months.

30

(4)  An authority maintaining a rotation list shall

notify in writing, not less than 14 days prior to the

2

removal, any towing company being removed from a rotation

3

list of the removal, the exact cause or causes for the

4

removal and the duration of time for which the removal shall

5

be in effect.

6

(5)  A towing company may appeal an authority's decision

7

to remove the towing company from a rotation list to the

8

magisterial district judge where the towing company's primary

9

facility is situated. The appeal shall constitute a de novo

10

hearing in accordance with Pennsylvania's Rules of Civil

11

Procedure.

12

(j)  Publication of logs and lists.--All rotation lists,

13

records of towing rotation lists, rotation list applications,

14

formal contracts with towing companies, towing logs or other

15

related documents and information that are maintained by an

16

authority are public records and, as such, are openly available

17

to towing companies and any other persons submitting requests

18

for such information under the act of February 14, 2008 (P.L.6,

19

No.3), known as the Right-to-Know Law.

20

(k)  Towing immunity.--

21

(1)  A towing company, when contracted by an authority

22

through a rotation list for emergency purposes, shall be

23

considered an employee of the Commonwealth as defined in 42

24

Pa.C.S. § 8501 (relating to definitions). This status shall

25

only apply while a towing company provides emergency towing

26

services.

27

(2)  A towing company, when contracted by an authority

28

through a rotation list for emergency purposes, shall be

29

granted governmental immunity as a Commonwealth employee, as

30

is established in 42 Pa.C.S. Ch. 85 Subch. C (relating to

actions against local parties). This immunity shall only

2

apply to activities a towing company encounters while

3

providing emergency towing services.

4

(3)  A towing company, when contracted by an authority

5

through a rotation list for emergency purposes, shall be

6

granted immunity from civil liability as established for

7

emergency personnel working for the Commonwealth in 35

8

Pa.C.S. § 7704 (relating to immunity from civil liability).

9

This immunity shall:

10

(i)  Only apply to activities the towing company

11

encounters while providing emergency towing services.

12

(ii)  Only extend to lawful activities performed by a

13

towing company and those activities of ordinary

14

negligence.

15

(iii)  Not protect from gross negligence, willful or

16

wanton misconduct or knowing misconduct.

17

Section 2.  This act shall take effect in 60 days.
