                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Allows commercial production and sale of bread, rolls and buns
made only with whole grain flours. Eliminates definition conflict
in statute regulating use of enriched flour.

                        A BILL FOR AN ACT
Relating to food; amending ORS 616.785, 625.212 and 625.215.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 625.212 is amended to read:
  625.212. As used in ORS 625.215   { - unless the context
requires otherwise - } :
    { - (1)(a) 'Bread,' 'white bread,' 'milk bread' and ' raisin
bread' have the meanings given those terms in the definitions and
standards promulgated by the State Department of Agriculture
pursuant to ORS 625.160. - }
    { - (b) As used in this subsection, 'bread' also includes
breads commonly known as Vienna, French and Italian. - }
    { - (2)(a) 'Rolls,' 'buns,' 'white rolls,' 'white buns, ' '
raisin rolls' and 'raisin buns' have the meanings given those
terms in the definitions and standards promulgated by the
department pursuant to ORS 625.160. - }
    { - (b) As used in this subsection, 'rolls' or 'buns '
includes doughnuts, sweet rolls or sweet buns made with fillings
or coatings, such as cinnamon, the soft rolls, such as Parker
House rolls, hamburger buns, hot dog buns and the hard rolls,
such as Vienna rolls or Kaiser rolls. However, 'rolls' or 'buns '
does not include foods made with specialty flours, such as cake
flour. - }
   { +  (1) 'Bread' means white bread, milk bread, raisin bread,
Vienna, French and Italian breads and other breads as identified
in definitions and standards adopted by the State Department of
Agriculture under ORS 625.160.
  (2) 'Buns' means white buns, hamburger buns, hot dog buns,
raisin buns, sweet buns made with fillings or coatings and other
buns as identified in definitions and standards adopted by the
department under ORS 625.160. 'Buns' does not include foods made
with cake flour or other specialty flours. + }
  (3)   { -  ' Enriched,' as applied to any of the breads, rolls
or buns defined in subsections (1) and (2) of this section, - }

vitamins, minerals and other nutrients   { - necessary - }  to
make   { - that food conform to the definition and standards
for - }  enriched bread, enriched rolls or enriched buns
 { - promulgated - }  { +  as identified in definitions and

   { +  (4) 'Rolls' means white rolls, Parker House and other
soft rolls, Vienna, Kaiser and other hard rolls, raisin rolls,
sweet rolls made with fillings or coatings, doughnuts and other
rolls as identified in definitions and standards adopted by the
department under ORS 625.160. 'Rolls' does not include foods made
with cake flour or other specialty flours. + }
  SECTION 2. ORS 625.215 is amended to read:
  625.215.   { - It shall be unlawful for any person to - }
 { + A person may not + } manufacture, bake, sell or offer for
sale  { + bread, rolls or buns + } for human consumption
 { - any of the breads, rolls or buns specified in ORS 625.212
(1) and (2) unless they - }  { +  unless the bread, rolls or
buns:
  (1) + } Are enriched { + ; or
  (2) Are made only with whole grain flours + }.
  SECTION 3. ORS 616.785 is amended to read:
  616.785. (1) It shall be unlawful for any person to
manufacture, mix, compound, sell or offer for sale for human
consumption any of the flours, macaroni products or noodle
products specified in ORS 616.775 (2) and (3) unless they are
enriched.
  (2) Subsection (1) of this section   { - shall - }  { +
does + } not apply to flours sold to distributors, commercial
bakers  { - , - }  or other processors if such flours will be:
  (a) Resold to a distributor, commercial baker or other
processor;
  (b) Used in the manufacture, mixing or compounding of:
  (A) Enriched flour, enriched macaroni products or enriched
noodle products; or
  (B)   { - Enriched breads, enriched rolls or enriched buns as
defined by ORS 625.212 (3) - }  { +  Bread, buns and rolls
described in ORS 625.215 + }; or
  (c) Used in the manufacture of a nonbakery product such as
specified in ORS 625.010 (2).
