A BILL
To enact section 3345.35 of the Revised Code to 1
authorize stipends for student athletes attending 2
public and private, nonprofit colleges and 3
universities.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 3345.35 of the Revised Code be 5
enacted to read as follows:6

       Sec. 3345.35.  (A) As used in this section, "institution of 7
higher education" means a state institution of higher education as 8
defined in section 3345.011 of the Revised Code and any nonprofit 9
institution with a certificate of authorization issued under 10
Chapter 1713. of the Revised Code.11

       (B) An institution of higher education annually may award a 12
stipend to a student athlete as follows:13

       (1) If the institution is a member of the division I 14
classification, or any equivalent succeeding classification, under 15
the national collegiate athletic association, or any succeeding 16
national organization that regulates intercollegiate athletic 17
conferences or events, an amount equal to or less than eight 18
thousand dollars.19

       (2) If the institution is a member of the division II 20
classification, or any equivalent succeeding classification, under 21
the national collegiate athletic association, or any succeeding 22
national organization that regulates intercollegiate athletic 23
conferences or events, an amount equal to or less than six 24
thousand dollars.25

       (3) If the institution is not described in division (B)(1) or 26
(2) of this section, an amount equal to or less than four thousand 27
dollars.28

       (C) A student athlete annually may receive stipends totalling 29
in the aggregate not more than four thousand dollars from sources 30
other than the institution of higher education in which the 31
student is enrolled.32

       (D) No institution of higher education, intercollegiate 33
athletic conference, or organization that regulates 34
intercollegiate athletic conferences or events shall have a rule, 35
bylaw, or other regulation that conflicts with this section.36
