A BILL
To enact sections 101.16, 101.161, and 101.162 of the 1
Revised Code to require conference committee 2
reports of appropriations and revenue bills to be 3
made publicly available forty-eight hours prior to 4
consideration by either house.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 101.16, 101.161, and 101.162 of the 6
Revised Code be enacted to read as follows:7

       Sec. 101.16. As used in sections 101.16 to 101.162 of the 8
Revised Code:9

       (A) "Appropriations bill" means any of the following:10

       (1) The main operating appropriations bill;11

       (2) The operating appropriations bill for state agencies 12
supported by motor fuel tax revenue;13

       (3) The operating appropriations bill or bills for the bureau 14
of workers' compensation and the industrial commission;15

       (4) Any bill that makes the principal operating 16
appropriations for one or more state agencies;17

       (5) Any bill that primarily contains corrections and 18
supplemental appropriations to the main operating appropriations 19
bill;20

       (6) The main capital appropriations bill;21

       (7) The bill that primarily contains reappropriations from 22
previous capital appropriations bills.23

       (B) "Revenue bill" means any bill raising revenue through 24
taxes, fees, or similar impositions.25

       (C) "Publicly available" means the posting of a bill on the 26
legislature's web site.27

       Sec. 101.161.  (A) Neither house of the general assembly may 28
consider a report of conference committee of an appropriations or 29
revenue bill until forty-eight hours after the bill is made 30
publicly available, excluding Saturdays, Sundays, and legal 31
holidays, unless the house considering the report of conference 32
committee is in session on such a day.33

       (B) The time the report of conference committee is made 34
publicly available shall be posted on the legislature's web site.35

       Sec. 101.162.  Either house of the general assembly, by a 36
two-thirds vote of its members, may waive application of section 37
101.161 of the Revised Code. The clerk of the house that waives 38
application shall enter the following into the daily journal of 39
that house with respect to the bill:40

       "The Legislature waives the forty-eight hour moratorium on 41
consideration of the report of conference committee required in 42
section 101.161 of the Revised Code."43
