A BILL
To enact section 3727.60 of the Revised Code to 1
require a hospital to provide information 2
regarding breast reconstruction to a patient 3
before obtaining the patient's consent for a 4
mastectomy, lymph node dissection, or lumpectomy.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 3727.60 of the Revised Code be 6
enacted to read as follows:7

       Sec. 3727.60.  Before obtaining a patient's consent to a 8
mastectomy, lymph node dissection, or lumpectomy, a hospital shall 9
provide all of the following to the patient in writing:10

       (A) Descriptions of the various breast reconstruction options 11
and the advantages and disadvantages of each option;12

       (B) Information on how breast reconstructive surgery can be 13
obtained, including information on obtaining the surgery at the 14
same hospital, if the hospital provides the surgery, and 15
information on obtaining the surgery at another facility;16

       (C) Information on the timing of the reconstructive surgery, 17
including the option of waiting until any chemotherapy or 18
radiation treatments have been completed;19

       (D) An explanation of the availability of health insurance 20
coverage for breast reconstruction and related services pursuant 21
to the federal "Women's Health and Cancer Rights Act of 1998," 112 22
Stat. 2681-436 (1998), 29 U.S.C. 1185b, as amended;23

       (E) Any other information the director of health considers 24
appropriate with respect to breast reconstruction.25
