          printed to be committed to the Committee on Local Government

        AN  ACT  to  authorize  the city of New York to discontinue a portion of
          real property in the county of the Bronx  as  parkland  and  to  grant
          easements  for  improvements  to  the  railroad  right-of-way to bring
          Metro-North railroad service to four new stations in the Bronx and  to
          Pennsylvania Station in the county of New York

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subject to the provisions of this act, but  notwithstanding
     2  any provision of any state or local law to the contrary, the city of New
     3  York  is  hereby  authorized  to discontinue the use as parklands of the
     4  lands described in section three of this act and to grant  easements  to
     5  the  metropolitan  transportation  authority  to enable the metropolitan
     6  transportation authority and Metro-North commuter railroad  company,  an
     7  affiliate  of  the  metropolitan  transportation authority, to construct
     8  improvements and gain ingress and egress to and from railroad equipment,
     9  stations and right-of-way on such  former  parkland,  and  to  construct
    10  below  surface  and  surface  utility  infrastructure, in order to bring
    11  Metro-North commuter railroad company service to four  new  stations  in
    12  the  Bronx  and  to Pennsylvania Station in the county of New York. Such
    13  easements shall be granted upon such terms and conditions as the city of
    14  New York and the metropolitan transportation authority shall  determine,
    15  including  terms  and  conditions  for  the  metropolitan transportation
    16  authority to ensure that the city of New York can  comply  with  section
    17  five of this act.
    18    §  2.  The metropolitan transportation authority, as consideration for
    19  being granted easements described in this act, shall pay to the city  of
    20  New  York the fair market value of the parklands being discontinued. The
    21  authorization provided in section one of this  act  shall  be  effective
    22  only  upon  the  condition that the city of New York dedicates an amount
    23  equal to or greater than the fair market value payable  by  metropolitan
    24  transportation  authority,  as  such  fair market value is determined in
    25  such easements, for the parklands being discontinued towards the  acqui-

     1  sition  of  new  parklands or capital improvements to existing parklands
     2  and recreational facilities within the borough of the Bronx.
     3    §  3.  The lands hereby authorized to be discontinued as parklands and
     4  for which easements may be granted to  the  metropolitan  transportation
     5  authority  are located in the county of the Bronx, city and state of New
     6  York, and are bounded and described as follows:
     7    BLOCK 3861, PART OF LOT 14:
     8    ALL THAT CERTAIN LOT, PIECE OR PARCEL  OF  LAND  SITUATED,  LYING  AND
     9  BEING  IN  THE BOROUGH OF THE BRONX, COUNTY, CITY, AND STATE OF NEW YORK
    10  BOUNDED AND DESCRIBED AS FOLLOWS:
    11    AREA STE-115-03: HORIZONTAL LIMITS
    12    Beginning at a point in the southeast line of Block 3861, Lot  14,  as
    13  depicted  to  the  City of New York (Reputed Owner) as per Reel 770 Page

     1    § 4. After completion of improvements to the former  parkland  granted
     2  to  the  metropolitan transportation authority pursuant to this act, the
     3  metropolitan transportation authority may, in its discretion, assign  or
     4  otherwise transfer some or all of the easements described in this act to
     5  the  National  Railroad  Passenger Corporation or the successor thereto,
     6  subject to retention of such rights and obligations of the  metropolitan
     7  transportation  authority  on  behalf  of  Metro-North commuter railroad
     8  company as the metropolitan transportation authority may deem  appropri-
     9  ate.
    10    §  5.  The discontinuance of parkland authorized by this act shall not
    11  occur until the city of New York has complied with any federal  require-
    12  ments  pertaining  to  the  alienation  or  conversion of the parklands,
    13  including satisfying the secretary of the interior that  the  conversion
    14  complies  with  all conditions which the secretary of the interior deems
    15  necessary to assure the provision of adequate recreation properties  and
    16  opportunities of reasonably equivalent location and usefulness.
    17    § 6. This act shall take effect immediately.
