        AN  ACT  to  authorize  the city of New York to discontinue a portion of
          real property in the county of the Bronx  as  parkland  and  to  grant
          easements  for  improvements  to  the  railroad  right-of-way to bring
          Metro-North railroad service to four new stations in the Bronx and  to
          Pennsylvania Station in the county of New York

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subject to the provisions of this act, but  notwithstanding
     2  any  provision  of  law  to the contrary, the city of New York is hereby
     3  authorized to discontinue the use as parklands of the lands described in
     4  section three of this act and to grant  easements  to  the  metropolitan
     5  transportation  authority,  upon  such  terms and conditions as the city
     6  shall determine, to enable the metropolitan transportation authority and
     7  Metro-North commuter railroad company, an affiliate of the  metropolitan
     8  transportation authority, to construct improvements and gain ingress and
     9  egress to and from railroad equipment, stations and right-of-way on such
    10  former  parkland,  and  to  construct  below surface and surface utility
    11  infrastructure, in order to bring Metro-North commuter railroad  company
    12  service to four new stations in the Bronx and to Pennsylvania Station in
    13  the county of New York.
    14    §  2.  The  authorization provided in section one of this act shall be
    15  effective only upon the condition that the city of New York dedicates an
    16  amount equal to or greater than the fair market of the  parklands  being
    17  discontinued  towards  the  acquisition  of new parklands and/or capital
    18  improvements to existing parklands and  recreational  facilities  within
    19  the borough of the Bronx.
    20    §  3.  The lands hereby authorized to be discontinued as parklands and
    21  for which easements may be granted to  the  metropolitan  transportation
    22  authority  are located in the county of the Bronx, city and state of New
    23  York, and are bounded and described as follows:

     1    § 4. In the event that the city of  New  York  received  any  funding,
     2  support  or  assistance  from  the  federal government for the purchase,
     3  maintenance or improvement of the parklands set forth in  section  three
     4  of  this act, the discontinuance and alienation of such parkland author-
     5  ized by the provisions of this act shall not occur until the city of New
     6  York has complied with any federal requirements pertaining to the alien-
     7  ation  or  conversion of such parklands, including satisfying the secre-
     8  tary of the interior that the alienation or conversion complies with all
     9  conditions which the secretary of the interior deems necessary to assure
    10  the substitution of other lands shall be   equivalent   in  fair  market
    11  value and usefulness to the lands being alienated or converted.
    12    §  5. After completion of improvements to the former  parkland discon-
    13  tinued and alienated by the city of New York pursuant to this  act,  the
    14  metropolitan transportation authority may, in its discretion, assign  or
    15  otherwise transfer some or all of the easements granted pursuant to this
    16  act  to the   National  Railroad  Passenger Corporation or the successor
    17  thereto, subject to retention of such  rights  and  obligations  of  the
    18  metropolitan  transportation   authority   on   behalf   of  Metro-North
    19  commuter railroad company as the metropolitan  transportation  authority
    20  may deem appropriate.
    21    § 6. Upon the completion of construction, the metropolitan transporta-
    22  tion  authority  shall,  in  agreement  with the city of New York and in
    23  consultation with the local community board, restore the surface of  the
    24  lands  described  in  section  three  of  this  act and such lands shall
    25  continue to be used for park purposes.
    26    § 7. This act shall take effect immediately.
