STATE OF NEW YORK ________________________________________________________________________ 8967 IN SENATE September 4, 2020 ___________ Introduced by Sen. MAYER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public service law, in relation to increasing penal- ties for certain violations committed by combination gas and electric corporations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a) of subdivision 5 of section 25-a of the 2 public service law, as added by section 2 of part X of chapter 57 of the 3 laws of 2013, is amended to read as follows: 4 (a) five hundred thousand dollars or [four one-hundredths] two-tenths 5 of one percent of the annual intrastate gross operating revenue of the 6 corporation, not including taxes paid to and revenues collected on 7 behalf of government entities, whichever is greater, constituting a 8 civil penalty for each separate and distinct offense; provided, however, 9 that for purposes of this paragraph each day of a continuing violation 10 shall not be deemed a separate and distinct offense. The total period of 11 a continuing violation, as well as every distinct violation shall be 12 similarly treated as a separate and distinct offense for purposes of 13 this paragraph; or 14 § 2.
