        Introduced  by  Sen. HELMING -- read twice and ordered printed, and when
          printed to be  committed  to  the  Committee  on  Rules  --  committee
          discharged, bill amended, ordered reprinted as amended and recommitted
          to said committee
        AN  ACT in relation to authorizing the town of Webster, county of Monroe
          to alienate and convey certain parcels of land used as parklands
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section 1. Subject to the provisions of this act, the town of Webster,
     2  county  of  Monroe,  acting  by and through its governing body, and upon
     3  such terms and conditions as determined by such body, is hereby  author-
     4  ized to discontinue as parklands and alienate the lands more particular-
     5  ly  described  in section three of this act, and to sell and convey such
     6  parklands at fair market value to the Webster  Central  School  District
     7  for  the  purposes  of  extending  the  school's sports and recreational
     8  fields.
     9    § 2. The authorization contained in section one of this act  shall  be
    10  effective  only  upon the condition that the town of Webster dedicate an
    11  amount equal to or greater than the fair market value of  the  parklands
    12  being  discontinued toward the acquisition of new parklands and/or capi-
    13  tal improvements to existing parkland and recreational facilities.
    14    § 3. The parkland authorized by section one of this act to  be  alien-
    15  ated,  commonly  known as "Town of Webster Park Parcel", is more partic-
    16  ularly described as follows:
    17    THAT TRACT OR PARCEL OF LAND situate in the Town of Webster, County of
    18  Monroe and State of New York, bounded and described as follows: COMMENC-
    19  ING at the centerline intersection of  Boulter  Industrial  Parkway  and
    20  Basket  Road-County  Road 4; thence S88°23'29"W, along the centerline of
    21  said Boulter Industrial Parkway, a distance of 913.00 feet to  a  point;
    22  thence   S01°36'31"E,  a  distance  of  30.00  feet  to  a  point;  then
    23  S88°23'29"W, a distance of 25.00 feet to a point; thence along  a  curve
    24  to the left, having a delta angle of 51°57'22", a radius of 170.00 feet,
    25  and  an  arc  length  of  154.16 feet, said curve also having a chord of
    26  S62°24'57"W 148.93 feet to a point; thence along a curve to  the  right,

     1  having  a  delta  angle of 52"28'47", a radius of 330.00 feet and an arc
     2  length of 302.26 feet, said curve also having  a  chord  of  S63°06'47"W
     3  291.81 feet to a point; thence S89°20'59"W, a distance of 429.52 feet to
     4  the  point  and  place of beginning; thence continuing S89°20'59"W along
     5  the aforesaid line, a  distance  of  450.21  feet  to  a  point;  thence
     6  N01°59'12"W, a distance of 637.43 feet to a point; thence N89°20"59"E, a
     7  distance  of  465.07  feet to a point; thence S00"39'02"E, a distance of
     8  637.25 feet to the point and place of beginning. Said parcel  containing
     9  6.695 acres, more or less.
    10    §  4.  In  the  event  that  the  town of Webster received any funding
    11  support or assistance from the  federal  government  for  the  purchase,
    12  maintenance  or  improvement of the parklands set forth in section three
    13  of this act, the discontinuance and alienation of such parkland  author-
    14  ized  by  the  provisions  of this act shall not occur until the town of
    15  Webster has complied with any federal  requirements  pertaining  to  the
    16  alienation  or  conversion of parklands, including satisfying the secre-
    17  tary of the interior that the alienation or conversion complies with all
    18  conditions which the secretary of the interior deems necessary to assure
    19  the substitution of other lands shall be equivalent in fair market value
    20  and usefulness to the lands being alienated or converted.
    21    § 5. This act shall take effect immediately.
