STATE OF NEW YORK ________________________________________________________________________ 8555 IN SENATE May 10, 2018 ___________ Introduced by Sen. LITTLE -- (at request of the New York State Homes and Community Renewal) -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Communi- ty Development AN ACT to amend the private housing finance law, in relation to the statewide or regional multi-state contract administration for Section 8 project based housing assistance payments contracts The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. This act shall be known and may be cited as the "project 2 based contract state and local administration act of 2018". 3 § 2. Subdivisions 10, 11 and 12 of section 45-a of the private housing 4 finance law, subdivision 10 as amended by chapter 215 of the laws of 5 1990, subdivision 11 as added by chapter 67 of the laws of 1985 and 6 renumbered by chapter 261 of the laws of 1988 and subdivision 12 as 7 amended by chapter 261 of the laws of 1988, are amended to read as 8 follows: 9 10. The corporation is a public housing agency as defined in the 10 United States Housing Act of 1937, as amended, and may receive and 11 administer funds including but not limited to subsidies, loans and fees 12 made available through federal programs under such act. 13 (a) The corporation shall be the sole entity with authority in New 14 York state to undertake any statewide or regional multi-state contract 15 administration for Section 8 project based housing assistance payments 16 contracts issued under the act. The corporation may in its discretion 17 subcontract such activities as it may require. The division of housing 18 and community renewal will be the entity responsible for such statewide 19 or regional multi-state contract administration with all powers and 20 responsibilities which would otherwise be available to the corporation 21 in the event the corporation is unable or unwilling to act as such enti- 22 ty. 23 (b) The powers vested in the corporation and the division of housing 24 and community renewal by paragraph a of this subdivision do not preclude 25 any other public housing agency operating within the state of New York EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD14714-01-8S. 8555 2 1 on the effective date of this paragraph, from continuing to operate, 2 administer or enter into any project based Section 8 contract or 3 contracts where the project is located within a political subdivision of 4 the state in which such public housing agency was operating on such 5 date. 6 11. The corporation may do any and all things necessary or convenient 7 to carry out and exercise the powers given and granted by this section 8 and article eighteen of this chapter including, but not limited to 9 contracting with the commissioner of the division of housing and commu- 10 nity renewal to administer any of the provisions of the special needs 11 housing act of 1988 and articles eighteen and eighteen-A of this chap- 12 ter. 13 [11.] 12. The division of housing and community renewal and all other 14 state officers, departments, boards, divisions, commissions, public 15 authorities and public benefit corporations may render such services to 16 the corporation within their respective functions as may be requested by 17 the corporation. 18 [12.] 13. Notwithstanding the provisions of article one-A of the 19 public authorities law, contracts entered into by the corporation pursu- 20 ant to articles eighteen and eighteen-A of this chapter shall not be 21 subject to the provisions of article one-A of the public authorities 22 law. 23 § 3. This act shall take effect immediately.
