        Introduced  by  Sen. ADDABBO -- read twice and ordered printed, and when
          printed to be committed to the Committee on Insurance

        AN ACT to amend the insurance  law,  in  relation  to  mandatory  health
          insurance coverage for lung cancer screening

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subsection (i) of section 3216  of  the  insurance  law  is
     2  amended by adding a new paragraph 39 to read as follows:
     3    (39)  (A) Every policy which provides medical, major medical, or simi-
     4  lar comprehensive-type coverage shall  provide  coverage  for  follow-up
     5  diagnostic  imaging  to assist in the diagnosis of lung cancer when such
     6  imaging is recommended by a  health  care  provider  acting  within  the
     7  provider's  scope  of  practice pursuant to title eight of the education
     8  law.
     9    (B) Such coverage required pursuant to this paragraph  shall  include,
    10  but  not be limited to, diagnostic ultrasounds, magnetic resonance imag-
    11  ing, computed tomography and image-guided biopsies.
    12    (C) Notwithstanding any  other  provision  of  law,  any  policy  that
    13  provides  coverage  required by this paragraph shall not impose a copay-
    14  ment, coinsurance or deductible requirement on coverage for lung  cancer
    15  screening  and  diagnosis that is greater than the copay, coinsurance or
    16  deductible requirement for breast cancer screening and diagnosis.
    17    § 2. Subsection (l) of section 3221 of the insurance law is amended by
    18  adding a new paragraph 22 to read as follows:
    19    (22) (A) Every policy which provides medical, major medical, or  simi-
    20  lar  comprehensive-type  coverage  shall  provide coverage for follow-up
    21  diagnostic imaging to assist in the diagnosis of lung cancer  when  such
    22  imaging  is  recommended  by  a  health  care provider acting within the
    23  provider's scope of practice pursuant to title eight  of  the  education
    24  law.
    25    (B)  Such  coverage required pursuant to this paragraph shall include,
    26  but not be limited to, diagnostic ultrasounds, magnetic resonance  imag-
    27  ing, computed tomography and image-guided biopsies.

     6    §  3.  Section  4303  of  the insurance law is amended by adding a new
     7  subsection (vv) to read as follows:
     8    (vv) (1) Every policy which provides medical, major medical, or  simi-
     9  lar  comprehensive-type  coverage  shall  provide coverage for follow-up
    10  diagnostic imaging to assist in the diagnosis of lung cancer  when  such
    11  imaging  is  recommended  by  a  health  care provider acting within the
    12  provider's scope of practice pursuant to title eight  of  the  education
    13  law.
    14    (2)  Such coverage required pursuant to this subsection shall include,
    15  but not be limited to, diagnostic ultrasounds, magnetic resonance  imag-
    16  ing, computed tomography and image-guided biopsies.
    17    (3)  Notwithstanding  any  other  provision  of  law,  any policy that
    18  provides coverage required by this subsection shall not impose a  copay-
    19  ment,  coinsurance or deductible requirement on coverage for lung cancer
    20  screening and diagnosis that is greater than the copay,  coinsurance  or
    21  deductible requirement for breast cancer screening and diagnosis.
    22    §  4.  This  act shall take effect on the ninetieth day after it shall
    23  have become a law and shall apply  to  policies  and  contracts  issued,
    24  renewed, modified, altered or amended on or after such effective date.
