STATE OF NEW YORK ________________________________________________________________________ 8204 IN SENATE October 12, 2016 ___________ Introduced by Sen. KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the alcoholic beverage control law, in relation to distiller's licenses The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraphs (v), (vi) and (vii) of paragraph (a) of 2 subdivision 2-c of section 61 of the alcoholic beverage control law, as 3 amended by chapter 384 of the laws of 2013, are amended to read as 4 follows: 5 (v) To conduct tastings of and sell at retail for consumption off the 6 premises New York state [labelled] labeled beer manufactured by a 7 licensed brewer or licensed farm brewery; 8 (vi) To conduct tastings of and sell at retail for consumption off the 9 premises New York state [labelled] labeled cider manufactured by a 10 licensed brewer, licensed farm brewery, licensed farm winery, licensed 11 cider producer or licensed farm cidery; and 12 (vii) To conduct tastings of and sell at retail for consumption off 13 the premises New York state [labelled] labeled wine manufactured by a 14 licensed winery or licensed farm winery. 15 § 2. Subparagraph (i) of paragraph (e) of subdivision 2-c of section 16 61 of the alcoholic beverage control law, as amended by chapter 431 of 17 the laws of 2014, is amended to read as follows: 18 (i) sell at retail for consumption on the licensed premises, any 19 [liquor manufactured by the licensee or any] New York state labeled 20 [liquor] alcoholic beverage. Provided, however, the licensee shall regu- 21 larly keep food available for sale or service to its retail customers 22 for consumption on the premises. A licensee providing the following 23 shall be deemed in compliance with this provision: sandwiches, soups or 24 other such foods, whether fresh, processed, pre-cooked or frozen; and/or 25 food items intended to compliment the tasting of alcoholic beverages, 26 which shall mean a diversified selection of food that is ordinarily 27 consumed without the use of tableware and can be conveniently consumed 28 while standing or walking, including but not limited to: cheese, fruits, EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD16088-01-6S. 8204 2 1 vegetables, chocolates, breads, mustards and crackers. All of the 2 provisions of this chapter relative to licenses to sell liquor at retail 3 for consumption on the premises shall apply so far as applicable to such 4 licensee; and 5 § 3. This act shall take effect immediately.
