        AN  ACT  to  amend  the  environmental  conservation law, in relation to
          prohibiting the use of certain heating oils in state, county and local
          government owned buildings
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  The environmental conservation law is amended by adding a
     2  new section 19-0329 to read as follows:
     3  § 19-0329. Heating oil requirements for government owned buildings.
     4    (1) Definitions. For the purpose of this section, the following  terms
     5  shall have the following meanings:
     6    (a) "Heating oil" means oil refined for the purpose of use as fuel for
     7  combustion in a heating system and that meets the specifications of ASTM
     8  designation  D  396-12  or  other  specifications  as  determined by the
     9  commission.
    10    (b) "Heating system" means a system that generates heat, hot air,  hot
    11  water  or  steam  by  combustion  and  distributes it within a building,
    12  provided that "heating system" shall not include wood burning stoves.
    13    (2)(a) No person shall cause or permit the use in any state, county or
    14  local government owned building or delivery  to  any  state,  county  or
    15  local  government  owned  building for use in such building, heating oil
    16  that is fuel oil grade no. 6 in an amount:
    17    (i) greater than eighty percent of the heating oil for such  building,
    18  on and after July first, two thousand nineteen;
    19    (ii)  greater than sixty percent of the heating oil for such building,
    20  on and after July first, two thousand twenty;
    21    (iii) greater than forty percent of the heating oil for such building,
    22  on and after July first, two thousand twenty-one; and
    23    (iv) greater than twenty percent of the heating oil for such building,
    24  on and after July first, two thousand twenty-two.
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1    (b) On and after July first, two thousand twenty-three no person shall
     2  cause or permit the use in any state, county or local  government  owned
     3  building  or  delivery  to  any  state, county or local government owned
     4  building for use in such building, heating oil that is  fuel  oil  grade
     5  no. 6 in any amount.
     6    (3)(a) No person shall cause of permit the use in any state, county or
     7  local  government  owned  building  or  delivery to any state, county or
     8  local government owned building for use in such  building,  heating  oil
     9  that is fuel oil grade no. 4 in an amount:
    10    (i)  greater than ninety percent of the heating oil for such building,
    11  on and after July first, two thousand nineteen;
    12    (ii) greater than eighty percent of the heating oil for such building,
    13  on and after July first, two thousand twenty;
    14    (iii) greater than seventy percent of the heating oil for such  build-
    15  ing, on and after July first, two thousand twenty-one;
    16    (iv)  greater than sixty percent of the heating oil for such building,
    17  on and after July first, two thousand twenty-two;
    18    (v) greater than fifty percent of the heating oil for  such  building,
    19  on and after July first, two thousand twenty-three;
    20    (vi)  greater than forty percent of the heating oil for such building,
    21  on and after July first, two thousand twenty-four;
    22    (vii) greater than thirty percent of the heating oil for  such  build-
    23  ing, on and after July first, two thousand twenty-five;
    24    (viii)  greater than twenty percent of the heating oil for such build-
    25  ing, on and after July first, two thousand twenty-six; and
    26    (ix) greater than ten percent of the heating oil for such building, on
    27  and after July first, two thousand twenty-seven.
    28    (b) On and after July first, two thousand twenty-eight no person shall
    29  cause or permit the use in any state, county or local  government  owned
    30  building  or  delivery  to  any  state, county or local government owned
    31  building for use in such building, heating oil that is  fuel  oil  grade
    32  no. 4 in any amount.
    33    (4)  The  governor  may,  by  issuing  an executive order, temporarily
    34  suspend the applicability of this section  at  any  time  based  on  the
    35  governor's determination, after consulting with the New York state ener-
    36  gy  research  and development authority and the department, that meeting
    37  the requirements of subdivision two or subdivision three of this section
    38  is not feasible due to lack of adequate supply of heating  oil  or  that
    39  meeting  the requirement would result in undue financial hardship to the
    40  state, county or local governments.
    41    § 2. This act shall take effect immediately.
