STATE OF NEW YORK ________________________________________________________________________ 8000 IN SENATE March 19, 2018 ___________ Introduced by Sen. BAILEY -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to requiring training for teachers and administrators in the area of childhood trauma The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3004 of the education law is amended by adding a 2 new subdivision 4-a to read as follows: 3 4-a. In recognizing the effects of trauma on the child development, 4 the commissioner shall prescribe regulations requiring that all persons 5 applying on or after January first, two thousand nineteen for a teaching 6 certificate or license as a special education teacher for the purposes 7 pursuant to article eighty-nine of this chapter shall, in addition to 8 all the other certification or licensing requirements, have completed 9 enhanced course work or training in the area of trauma as it relates to 10 children and its impact on child development and learning. In addition, 11 such regulations shall require that enhanced training in the needs of 12 children who have experienced trauma be provided to each certified 13 school administrator or supervisor assigned on or after January first, 14 two thousand nineteen to serve as a school administrator including a 15 special education administrator. Such training shall be provided prior 16 to, or as soon as practicable following, assignment as a school adminis- 17 trator or special education administrator. Individuals serving as school 18 administrators or special education administrators as of January first, 19 two thousand nineteen shall complete such training by such date. The 20 enhanced course work or training shall be obtained from an institution 21 or provider which has been approved by the department to provide such 22 course work or training in the needs of those who have experienced trau- 23 ma, provided that enhanced training for certified school administrators 24 or supervisors that meets standards prescribed by the commissioner may 25 be included in the professional development provided by the school 26 district or board of cooperative educational services to such adminis- 27 trators or supervisors. 28 § 2.
