MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT authorizing the county of Nassau to alienate certain parcels of land used as parkland THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The county of Nassau is hereby authorized, acting by and 2 through its legislature, and upon such terms and conditions as deter- 3 mined by such legislature, to discontinue as parkland the lands 4 described in section three of this act for the purpose of enabling the 5 Roslyn Water District to construct, maintain and operate a water treat- 6 ment facility and appurtenances thereto. 7 S 2. The authorization contained in section one of this act shall be 8 effective only upon the condition that the county of Nassau dedicate an 9 amount equal to or greater than the fair market value of the parkland 10 being discontinued for funding of capital improvements, to existing park 11 and recreational facilities. 12 S 3. The lands to be discontinued as parklands and alienated are 13 described as follows: 14 All that certain piece or parcel of land situated at North Hills, Town 15 of North Hempstead, County of Nassau and State of New York, being known 16 as a portion of Lot 903 "Christopher Morley Park", Block E as it appears 17 on a certain map entitled "Department of Public Works Nassau County NY 18 Map Showing Real Property To Be Acquired For Park Purposes East of Sear- 19 ingtown Road And North Of Long Island Expressway North Hills Town Of 20 North Hempstead" filed with the Clerk of the County of Nassau on Septem- 21 ber 29, 1961 as Case No. 7496, said parcel being more particularly 22 described as follows: 23 Beginning at a point on the southerly side of Diana's Trail. Said 24 point being the following two courses from the intersection of the 25 southerly side of Diana's Trail with the westerly side of The Tulips: 26 1. South 89 degrees, 18 minutes, 51 seconds west, 237.50 feet. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD15243-04-4 S. 7596--A 2 1 2. South 87 degrees, 37 minutes, 30 seconds west, 437.00 feet to a 2 point or place of beginning. 3 Thence through lands the County of Nassau the following seven (7) 4 courses: 5 1. South 02 degrees, 22 minutes, 30 seconds east, 320.00 feet. 6 2. North 87 degrees, 37 minutes, 30 seconds east, 70.00 feet. 7 3. South 02 degrees, 22 minutes, 30 seconds east, 120.00 feet. 8 4. South 87 degrees, 37 minutes, 30 seconds west, 120.00 feet. 9 5. North 02 degrees, 22 minutes, 30 seconds west, 120.00 feet. 10 6. North 87 degrees, 37 minutes, 30 seconds east, 20.00 feet. 11 7. North 02 degrees, 22 minutes, 30 seconds west, 320.00 feet to the 12 southerly side of Diana's Trail. 13 Thence easterly along the southerly side of Diana's Trail North 87 14 degrees, 37 minutes, 30 seconds east, 30.00 feet to the point or place 15 of beginning. 16 Continuing within said bounds 24,000. S.F. or 0.44 Acres. 17 Nassau County Tax Map Section 7, Block E, Part of Lot 903. 18 S 4. The discontinuance of parkland authorized by the provisions of 19 this act shall not occur until the county of Nassau has complied with 20 any federal requirements pertaining to the alienation or conversion of 21 parklands, including satisfying the secretary of the interior that the 22 alienation or conversion complies with all conditions which the secre- 23 tary of the interior deems necessary to assure the substitution of other 24 lands shall be equivalent in fair market and recreational usefulness to 25 the lands being alienated or converted. 26 S 5. When the lands described in section three of this act cease to be 27 used for the purposes described in section one of this act, those lands 28 shall be restored for park purposes with the cost of restoration being 29 borne by the Roslyn Water District. 30 S 6. This act shall take effect immediately.
