STATE OF NEW YORK ________________________________________________________________________ 7466 IN SENATE May 4, 2016 ___________ Introduced by Sen. GOLDEN -- (at request of the Department of Civil Service) -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the civil service law, in relation to long term care insurance for state and retired state employees The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 172 of the civil service law, a added by chapter 2 585 of the laws of 1998, is amended to read as follows: 3 § 172. Long term care insurance. 1. The president is hereby authorized 4 [and directed] to establish a long term care insurance plan for state 5 officers and employees and their dependents and officers and employees 6 of the state colleges of agriculture, home economics, industrial labor 7 relations and veterinary medicine, the state agricultural station at 8 Geneva, and any other institution or agency under the management and 9 control of Cornell University as the representative of the board of 10 trustees of the state university of New York, and the state college of 11 ceramics under the management and control of Alfred University as the 12 representative of the board of trustees of the state university of New 13 York and their dependents, and for the employees and retired employees 14 of public authorities, public benefit corporations, school districts, 15 special districts, district corporations, municipal corporations exclud- 16 ing active employees and retired employees of cities having a population 17 of one million or more inhabitants whose compensation is or was before 18 retirement paid out of the city treasury, or other appropriate agencies, 19 subdivisions or quasi-public organizations of the state and their depen- 20 dents as defined by the regulations of the president, which, subject to 21 the conditions and limitations contained in this article, and in the 22 regulations of the president, will provide for insurance against the 23 financial costs of long term care. 24 § 2. Subdivision 1 of section 173 of the civil service law, as added 25 by chapter 585 of the laws of 1998, is amended to read as follows: 26 1. The president is hereby authorized [and directed] to purchase a 27 contract or contracts to provide long term care benefits under the long EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. [Such] If purchased, such long term care contract or 3 contracts shall be purchased from one or more corporations authorized 4 under section one thousand one hundred seventeen of the insurance law to 5 issue long term care insurance contracts in this state. 6 § 3. This act shall take effect immediately.
