HANNON, LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Health -- reported favorably from said committee and committed to the Committee on Rules -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the social services law, in relation to directing the commissioner of health to develop a standard prior prescription drug authorization request form for managed care providers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 364-j of the social services law is amended by 2 adding a new subdivision 26 to read as follows: 3 26. THE COMMISSIONER OF HEALTH SHALL DEVELOP A STANDARD PRIOR AUTHORI- 4 ZATION REQUEST FORM OR FORMS TO BE UTILIZED BY ALL MANAGED CARE PROVID- 5 ERS FOR PURPOSES OF SUBMITTING A REQUEST FOR A UTILIZATION REVIEW DETER- 6 MINATION FOR COVERAGE OF PRESCRIPTION DRUG BENEFITS UNDER THIS TITLE. 7 THE MANAGED CARE PROVIDER SHALL MAKE THE STANDARD PRIOR AUTHORIZATION 8 REQUEST FORM OR FORMS AVAILABLE TO, AND SHALL ACCEPT IT OR THEM FROM, 9 PRESCRIBING PROVIDERS IN PAPER AND ELECTRONIC FORM. 10 S 2. This act shall take effect immediately; provided, however, that 11 the amendment to section 364-j of the social services law, made by 12 section one of this act shall not affect the repeal of such section and 13 shall be deemed repealed therewith.
