          recommitted  to the Committee on Environmental Conservation in accord-
          ance with Senate Rule 6, sec. 8 -- committee discharged, bill amended,
          ordered reprinted as amended and recommitted to said committee

        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          prohibiting certain uses of trichloroethylene

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The environmental conservation law is amended by  adding  a
     2  new section 37-0117 to read as follows:
     3  § 37-0117. Prohibition against certain uses of trichloroethylene.
     4    1.  Beginning  January first, two thousand twenty-one, no person shall
     5  use trichloroethylene as a vapor degreaser, an intermediate chemical  to
     6  produce  other  chemicals, a refrigerant, or an extraction solvent or in
     7  any other manufacturing or cleaning process or use;  provided,  however,
     8  that dry cleaning establishments shall be permitted to use up to, but no
     9  more  than,  one gallon of trichloroethylene per calendar year; provided
    10  further, however, that the owner or operator of a  dry  cleaning  estab-
    11  lishment  shall  prohibit persons of childbearing age from being present
    12  in a room in which trichloroethylene is being used for the  duration  of
    13  the use of the tricholoroethylene.
    14    2.  Any  person  required  to  comply  with this section shall replace
    15  trichloroethylene with a chemical demonstrated to be less toxic to human
    16  health and approved by the commissioner.
    17    3. For purposes of this section:
    18    (a) "Extraction solvent" means a solvent used to separate  a  specific
    19  substance from a mixture.
    20    (b)  "Person"  means  any  individual, firm, association, partnership,
    21  corporation, organization, or joint venture.

     1    (c) "Refrigerant" means a chemical that is used as a heat carrier in a
     2  cooling mechanism and that changes from liquid to gas and back again  in
     3  the refrigeration cycle.
     4    (d)  "Trichloroethylene"  means  a chemical with the Chemical Registry
     5  Abstract Services Number of 79-01-6.
     6    (e) "Vapor degreaser"  means  a  substance  boiled  to  a  vapor  that
     7  condenses  onto  metal  parts,  causing  beading  and dripping, and that
     8  removes contaminants from the parts.
     9    § 2. This act shall take effect immediately.
