STATE OF NEW YORK ________________________________________________________________________ 6829 2019-2020 Regular Sessions IN SENATE November 1, 2019 ___________ Introduced by Sen. KAMINSKY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the environmental conservation law, in relation to prohibiting certain uses of trichloroethylene The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The environmental conservation law is amended by adding a 2 new section 37-0115 to read as follows: 3 § 37-0115. Prohibition against certain uses of trichloroethylene. 4 1. Beginning January 1, 2021, no person shall use trichloroethylene as 5 a vapor degreaser, an intermediate chemical to produce other chemicals, 6 a refrigerant, or an extraction solvent or in any other manufacturing or 7 cleaning process or use. 8 2. Any person required to comply with this section shall replace 9 trichloroethylene with a chemical demonstrated to be less toxic to human 10 health and approved by the commissioner. 11 3. For purposes of this section: 12 (a) "Extraction solvent" means a solvent used to separate a specific 13 substance from a mixture. 14 (b) "Person" means any individual, firm, association, partnership, 15 corporation, organization, or joint venture. 16 (c) "Refrigerant" means a chemical that is used as a heat carrier in a 17 cooling mechanism and that changes from liquid to gas and back again in 18 the refrigeration cycle. 19 (d) "Trichloroethylene" means a chemical with the Chemical Registry 20 Abstract Services Number of 79-01-6. 21 (e) "Vapor degreaser" means a substance boiled to a vapor that 22 condenses onto metal parts, causing beading and dripping, and that 23 removes contaminants from the parts. 24 § 2.
