         when printed to be committed to the Committee on Environmental Conser-
         vation
       AN ACT to amend the environmental conservation law, in relation  to  the
         provisions  of  grants  for the best available retrofit technology for
         heavy duty vehicles; and to  amend  the  public  authorities  law,  in
         relation  to authorizing the New York state energy research and devel-
         opment authority to expend funds for  retrofit  technology  for  heavy
         duty vehicles
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 3  of  section  19-0323  of  the  environmental
    2  conservation law, as amended by section 1 of part U of chapter 58 of the
    3  laws of 2013, is amended to read as follows:
    4    3. Any diesel powered heavy duty vehicle that is owned by, operated by
    5  or  on  behalf  of,  or  leased by a state agency and state and regional
    6  public authority with more than half of its governing body appointed  by
    7  the  governor  shall  utilize the best available retrofit technology for
    8  reducing the emission of pollutants.  THE NEW YORK STATE ENERGY RESEARCH
    9  AND DEVELOPMENT AUTHORITY SHALL PROVIDE TO SUCH STATE AGENCIES AND STATE
   10  AND REGIONAL PUBLIC AUTHORITIES, AND CONTRACTORS OPERATING ON BEHALF  OF
   11  STATE AGENCIES AND STATE AND REGIONAL PUBLIC AUTHORITIES, WITHIN AMOUNTS
   12  APPROPRIATED,  GRANTS  FOR  THE  BEST AVAILABLE RETROFIT TECHNOLOGY. The
   13  commissioner shall promulgate regulations for the implementation of this
   14  subdivision specifying that all vehicles  covered  by  this  subdivision
   15  shall  have best available retrofit technology on or before December 31,
   16  2014.
   17    This subdivision shall not apply to any vehicle subject to a lease  or
   18  public  works  contract  entered  into or renewed prior to the effective
   19  date of this section.
   20    S 2. Subdivision 18 of section 1854 of the public authorities law,  as
   21  added by chapter 488 of the laws of 2009, is amended to read as follows:
   22    18.  To  provide  for  the deposit of all or a portion of the proceeds
   23  collected by the authority from the auction or sale of  emission  allow-

    1  ances  allocated  by the department of environmental conservation to the
    2  authority pursuant to regulations adopted by the department of  environ-
    3  mental  conservation  to  a  green jobs-green New York fund to be estab-
    4  lished  in the custody of the commissioner of taxation and finance.  The
    5  monies in such fund shall be available for the green jobs-green New York
    6  program pursuant to title nine-A of article eight of this  chapter;  AND
    7  FOR  THE  INSTALLATION OF BEST AVAILABLE RETROFIT TECHNOLOGY PURSUANT TO
    8  SECTION 19-0323 OF THE ENVIRONMENTAL CONSERVATION LAW.
    9    S 3. This act shall take effect immediately.
