MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to direct the commissioner of general services to purchase certain properties in the town of Oyster Bay The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding any other provision of law to the contrary, 2 the commissioner of general services is hereby authorized and directed 3 to purchase the following parcel of land for fair market value from the 4 town of Oyster Bay. 5 Such parcel includes: 6 Land commonly known as Goat Hill, Pine Hollow Road in East Norwich, 7 Section 24, Block B, Lot 377, constituting 43.21 acres: 8 All of the undivided one-half interest in the following described 9 premises: 10 ALL That certain plot, piece or parcel of land, with the buildings and 11 improvements thereon erected, situate, lying and being at East Norwich, 12 in the Town of Oyster Bay, County of Nassau and State of New York, 13 bounded and described as follows: BEGINNING at a point on the easterly 14 line of Terrace Lane, said point being 321.91 feet northerly from the 15 terminus of an arc connecting the northerly line of Lawn Lane with the 16 easterly line of Terrace Lane; running thence northerly along the east- 17 erly line of Terrace Lane; the following five (5) courses and distances: 18 (1) North 13 degrees 13 minutes 00 seconds west, 411.26 feet. (2) 19 along a curve to the right having a radius of 153.92 feet and a length 20 of 124.93 feet. (3) North 33 degrees 17 minutes 20 seconds east 49.53 21 feet. (4) along a curve to the left having a radius of 309.96 feet and 22 a length of 292.94 feet. Subject to the provisions of this act, the town of Oyster Bay, 29 acting by and through its governing body, is hereby authorized to 30 discontinue as parklands and alienate the lands more particularly 31 described in section three of this act, and to grant an access easement 32 over such parklands at fair market value and upon such other terms and 33 conditions as determined by the governing body of the town of Oyster Bay 34 to the state of New York. 35 § 3. The authorization provided in section two of this act shall be 36 effective only upon the condition that the town of Oyster Bay dedicate 37 an amount equal to or greater than the fair market value of the easement 38 interest being alienated pursuant to section two of this act to the 39 acquisition of new parklands and/or improvements to existing parklands. 40 Land commonly known as Washington Avenue, in Plainview, Section 13, 41 Block B, Lot 354, constituting 9 acres: 42 DESCRIPTION OF REAL PROPERTY 43 KNOWN AS 44 354 BLOCK B, SECTION 13 OF 45 THE NASSAU COUNTY LAND AND TAX MAP 46 All that certain plot, piece or parcel of land, situate, lying and 47 being at Plainview, Town of Oyster Bay, County of Nassau and State of 48 New York, said parcel being more particularly described as follows: 49 COMMENCING at a point formed by the intersection of the old northerly 50 line of the Long Island Expressway-North Service Road with the westerly 51 line of Round Swamp Road; 52 RUNNING THENCE from said point of commencement the following two (2) 53 courses: 54 1. THENCE N 63°-27'-35" W a distance of 200.05 feet as measured along 55 said old northerly line of the Long Island Expressway-North Service Road 56 to the division line between Nassau County and Suffolk County (alsoS. 6587 3 1 being the division line between the Town of Oyster Bay and Town of Hunt- 2 ington); 3 2. THENCE N 00°-05'-04" E a distance of 2090.85 feet along said divi- 4 sion line to the true point of beginning; 5 CONTINUING from said point of beginning the following ten (10) cours- 6 es, the first four courses being along the southerly line of the parcel 7 described herein; 8 1. THENCE N 46°-28'-12"W a distance of 166.54 feet; 9 2. THENCE N 77°-34'-36"W a distance of 94.46 feet; 10 3. THENCE S 87°-47'-32"W a distance of 130.12 feet; 11 4. THENCE S 00°-05'-04"W a distance of 1086.92 feet along said divi- 20 sion line to the point or place of beginning. 21 Containing within said bounds 9.00 acres more or less. 22 § 4. In the event that the town of Oyster Bay received any funding, 23 support or assistance from the federal government for the purchase, 24 maintenance or improvement of the parkland set forth in section three of 25 this act, the discontinuance and alienation of such parkland authorized 26 by the provisions of section three of this act shall not occur until the 27 town of Oyster Bay has complied with any federal requirements pertaining 28 to the alienation or conversion of such parklands, including satisfying 29 the secretary of the interior that the alienation or conversion complies 30 with all conditions which the secretary of the interior deems necessary 31 to assure the substitution of other lands shall be equivalent in fair 32 market value and usefulness to the lands being alienated or conveyed. 33 § 5. This act shall take effect immediately.
