GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to the validity of certificates attesting to the satisfactory completion of an approved municipal police basic training program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph (b) of subdivision 1 of section 209-q of the 2 general municipal law, as amended by chapter 551 of the laws of 2001, is 3 amended to read as follows: 4 (b) A certificate attesting to satisfactory completion of an approved 5 municipal police basic training program awarded by the executive direc- 6 tor of the municipal police training council pursuant to this subdivi- 7 sion shall remain valid: 8 (i) during the holder's continuous service as a police officer or 9 peace officer who has an equivalency certificate for police officer 10 training or an approved course for state university of New York public 11 safety officers issued in accordance with subdivision three of section 12 eight hundred forty-one of the executive law; and 13 (ii) for two years after the date of the commencement of an inter- 14 ruption in such service where the holder had, immediately prior to such 15 interruption, served as a police officer or peace officer who has an 16 equivalency certificate for police officer training or an approved 17 course for state university of New York public safety officers issued in 18 accordance with subdivision three of section eight hundred forty-one of 19 the executive law, for less than two consecutive years; or 20 (iii) for four years after the date of the commencement of an inter- 21 ruption in such service where the holder had, immediately prior to such 22 interruption, served as a police officer or peace officer who has an 23 equivalency certificate for police officer training or an approved 24 course for state university of New York public safety officers issued in 25 accordance with subdivision three of section eight hundred forty-one of 26 the executive law, for two consecutive years or longer; [or] EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14342-01-2 S. 6579 2 1 (iv) where the holder, whose interruption in continuous service as a 2 police officer does not exceed ten years, has satisfactorily completed 3 an approved police officer refresher course or where a peace officer, 4 who seeks an equivalency certificate for police officer training or an 5 approved course for state university of New York public safety officers 6 issued in accordance with subdivision three of section eight hundred 7 forty-one of the executive law, has satisfactorily completed relevant 8 police officer training courses, as prescribed by the municipal police 9 training council; OR 10 (V) FOR THE ENTIRE PERIOD OF INTERRUPTION IN CONTINUOUS SERVICE, WHERE 11 THE HOLDER HAS PREVIOUSLY SERVED AS POLICE OFFICER AND HAS AN EQUIVALEN- 12 CY CERTIFICATE FOR POLICE OFFICER TRAINING, PROVIDED HOWEVER, THAT SUCH 13 INTERRUPTION CONSISTED OF SERVING AS A PEACE OFFICER FOR STATE OR LOCAL 14 GOVERNMENTS OR ANY INSTRUMENTALITIES THEREOF. 15 S 2. This act shall take effect on the one hundred twentieth day after 16 it shall have become a law.
