Section 3635 of the education law is amended by adding a 2 new subdivision 3 to read as follows: 3 3. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR REGULATION TO 4 THE CONTRARY, IN CITIES WITH A POPULATION OF ONE MILLION OR MORE, THE 5 REQUIREMENT OF PARAGRAPH C OF SUBDIVISION ONE OF THIS SECTION, REQUIRING 6 THAT A CITY SCHOOL DISTRICT PROVIDING TRANSPORTATION FOR CHILDREN RESID- 7 ING WITHIN SUCH DISTRICT OFFER SUCH TRANSPORTATION EQUALLY TO ALL SUCH 8 CHILDREN IN LIKE CIRCUMSTANCES, SHALL NOT APPLY TO THE USE OF EXISTING 9 CONTRACT BUS SERVICE PROVIDED FOR CHILDREN IN ELEMENTARY GRADES BY 10 PUPILS IN GRADES SEVEN AND EIGHT, BUT ONLY WHERE SUCH USE IS A REIN- 11 STATEMENT OF A SERVICE PROVIDED IN THE SCHOOL YEAR BEGINNING IN SEPTEM- 12 BER, TWO THOUSAND NINE AND ENDING IN JUNE TWO THOUSAND TEN. 13 S 2.
