          printed to be committed  to  the  Committee  on  Local  Government  --
          reported  favorably from said committee and committed to the Committee
          on Rules -- committee discharged, bill amended, ordered  reprinted  as
          amended and recommitted to said committee
        AN  ACT to legalize, validate, ratify and confirm certain actions of the
          Candor Fire District and the  village  of  Candor  relating  to  their
          provision  of  fire protection services within the territorial bounda-
          ries of the village of Candor, and authorizing the creation of a joint
          fire district
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Legislative  findings.  It is hereby found and determined
     2  that the Candor fire district, town of Candor  and  village  of  Candor,
     3  each  being  located  in Tioga County, have since 2007, acted consistent
     4  with all applicable provisions of article 11-A of the town law and arti-
     5  cle 22-A of the village  law  in  the  governance  of  the  Candor  fire
     6  district  providing  fire protection services to the town and village of
     7  Candor notwithstanding the failure of the town  of  Candor  to  properly
     8  hold hearings and adopt a resolution subject to permissive referendum as
     9  was required by law in establishment of a new joint fire district.
    10    §  2. The dissolution of the Candor fire district and the formation of
    11  a new joint Candor fire district covering the territorial boundaries  of
    12  the  town  of  Candor  and  the  village  of Candor, and all actions and
    13  proceedings taken in connection with such dissolution and formation,  to
    14  the  extent otherwise authorized by law, commencing on March 1, 2007 and
    15  prior to the effective date of this act are hereby legalized,  validated
    16  and  ratified, notwithstanding the town of Candor's failure to adhere to
    17  the provisions of the former sections 185 and 189-c of the town law that
    18  required the holding of hearings and adoption of a resolution subject to

     1  a permissive referendum in relation to the dissolution  of  an  existing
     2  fire district and establishment of a new joint fire district.
     3    §  3.  Commencing upon the effective date of this act, the boundary of
     4  the Candor fire district shall continue to include the territorial boun-
     5  daries of the town of Candor  and  village  of  Candor,  and  such  fire
     6  district  shall continue to have all the powers, duties and responsibil-
     7  ities vested in and imposed by article 11-A of the town law,  and  shall
     8  be  subject  to  all  limitations, procedures and restrictions set forth
     9  therein.
    10    § 4. This act shall take effect immediately.
