STATE OF NEW YORK ________________________________________________________________________ 5653 2019-2020 Regular Sessions IN SENATE May 10, 2019 ___________ Introduced by Sen. METZGER -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the prescription monitoring program registry being used to investigate prescribers The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 7 of section 3343-a of the public health law, 2 as added by section 2 of part A of chapter 447 of the laws of 2012, is 3 amended to read as follows: 4 7. Department analysis of data. (a) The department shall periodically 5 analyze data contained in the prescription monitoring program registry 6 to identify information that indicates that a violation of law or breach 7 of professional standards may have occurred and, as warranted, provide 8 any relevant information to appropriate entities as permitted under 9 section thirty-three hundred seventy-one of this article. The department 10 shall keep a record of the information provided, including, but not 11 limited to, the specific information provided and the agency to which 12 such information was provided, including the name and title of the 13 person to whom such information was provided and an attestation from 14 such person that he or she has authority to receive such information. 15 (b) The department shall identify and investigate prescribers with 16 statistically high prescribing patterns. If the department reasonably 17 believes after such investigation that a violation of the law has 18 occurred the department shall provide such information to the attorney 19 general. 20 § 2.
