RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring the commissioner to update a licensee's photo image at least every eight years THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph (a) of subdivision 6 of section 502 of the vehi- 2 cle and traffic law, as amended by section 3 of part K of chapter 59 of 3 the laws of 2009, is amended to read as follows: 4 (a) A license issued pursuant to subdivision five of this section 5 shall be valid until the expiration date contained thereon, unless such 6 license is suspended, revoked or cancelled. Such license may be renewed 7 by submission of an application for renewal, the fee prescribed by law, 8 proofs of prior licensing, fitness and acceptable vision prescribed by 9 the commissioner, the applicant's social security number, and if 10 required by the commissioner a photo image of the applicant in such 11 numbers and form as the commissioner shall prescribe. THE COMMISSIONER 12 SHALL, AT A MINIMUM OF EVERY EIGHT YEARS, UPDATE A LICENSEE'S PHOTO 13 IMAGE AND SHALL PROVIDE LICENSEES WITH THE OPTION OF SUBMITTING SUCH 14 PHOTO IMAGE ELECTRONICALLY IN A MANNER PRESCRIBED BY THE COMMISSIONER AT 15 NO ADDITIONAL COST TO THE LICENSEE. In addition, an applicant for 16 renewal of a license containing a hazardous material endorsement shall 17 pass an examination to retain such endorsement. The commissioner shall, 18 with respect to the renewal of a hazardous materials endorsement, comply 19 with the requirements imposed upon states by sections 383.141 and 20 1572.13 of title 49 of the code of federal regulations. A renewal of 21 such license shall be issued by the commissioner upon approval of such 22 application, except that no such license shall be issued if its issuance 23 would be inconsistent with the provisions of section five hundred 24 sixteen of this title, and except that the commissioner may refuse to EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. This act shall take effect immediately; provided, however, that 5 effective immediately, the addition, amendment and/or repeal of any rule 6 or regulation necessary for the timely implementation of this act on its 7 effective date are authorized and directed to be made and completed on 8 or before such effective date.
