        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health

        AN ACT to amend the public health law, in relation to prohibiting  nurs-
          ing  homes  and  care facilities from denying admission to individuals
          receiving a controlled substance medication for a substance use disor-
          der

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 3 of section 2803-c of the public health law is
     2  amended by adding a new paragraph s to read as follows:
     3    s.  No  nursing  home  or  facility providing health related services,
     4  which is registered with the state of New York and registered  with  the
     5  federal Drug Enforcement Agency, that maintains a stock of, and directly
     6  dispenses, controlled substance medications, as defined in section thir-
     7  ty-three  hundred  six of this chapter, shall deny admission to an indi-
     8  vidual  who  is  receiving  a  controlled  substance  medication  for  a
     9  substance use disorder.
    10    § 2. This act shall take effect immediately.
