        AN  ACT to amend the social services law, in relation to requiring local
          social services districts to offer to pay childcare  providers  via  a
          direct deposit for any subsidized child care funds owed

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 390-c of the social services law, as added by chap-
     2  ter 460 of the laws of 2000, is amended by adding a new subdivision 4 to
     3  read as follows:
     4    4. The commissioner of children and family services is authorized  and
     5  directed,  no later than one year from the effective date of this subdi-
     6  vision, to promulgate rules and regulations to require that local social
     7  services districts offer child day care providers, as defined in section
     8  three hundred ninety of this title, the option to  be  paid  any  monies
     9  owed  for  providing  subsidized child care by a deposit directly into a
    10  bank account of the child day care provider. Such direct  deposit  shall
    11  only be made at the express written consent of the provider and shall be
    12  requested  on  forms  provided by the local social services district and
    13  duly filled in by the provider. Such written consent can be  revoked  at
    14  any  time  by  the  provider  in  writing on forms provided by the local
    15  social services district.
    16    § 2. This act shall take effect immediately.
