         printed to be committed to the Committee on Investigations and Govern-
         ment Operations
       AN ACT to amend the public officers law, in relation to willful  failure
         to make timely disclosure of a public record
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 89 of the public officers law is amended by  adding
    2  a new subdivision 10 to read as follows:
    3    10. ANY OFFICER OR EMPLOYEE OF A STATE AGENCY CHARGED WITH THE DISCLO-
    4  SURE  OF  ANY  RECORD  IN COMPLIANCE WITH THE PROVISIONS OF THIS ARTICLE
    5  SHALL MAKE SUCH DISCLOSURE WITHIN THE  TIME  PERIODS  PROVIDED  IN  THIS
    6  SECTION.  ANY  AGENCY WHICH EMPLOYS A PERSON WHO HAS WILLFULLY FAILED TO
    7  MAKE TIMELY DISCLOSURE OF SUCH RECORD SHALL BE SUBJECT TO A CIVIL PENAL-
    8  TY IN AN AMOUNT NOT TO EXCEED ONE THOUSAND DOLLARS.
    9    S 2. This act shall take effect on the ninetieth day  after  it  shall
   10  have become a law.
