       AN ACT to amend the vehicle and traffic law,  in  relation  to  allowing
         vehicles containing three or more passengers to utilize the high occu-
         pancy vehicle lane on the Staten Island expressway
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Article 12 of the vehicle and traffic  law  is  amended  by
    2  adding a new section 397-c to read as follows:
    3    S  397-C. UTILIZATION OF THE HIGH OCCUPANCY VEHICLE LANE ON THE STATEN
    4  ISLAND EXPRESSWAY. THE DEPARTMENT OF TRANSPORTATION SHALL ALLOW VEHICLES
    5  CONTAINING THREE OR MORE PASSENGERS GOING EITHER  NORTHBOUND  OR  SOUTH-
    6  BOUND  ON  INTERSTATE  TWO  HUNDRED  SEVENTY-EIGHT THROUGH THE COUNTY OF
    7  RICHMOND, FOR THOSE PORTIONS OF SUCH  INTERSTATE  KNOWN  AS  THE  STATEN
    8  ISLAND  EXPRESSWAY  AND  CONTAINING  A  HIGH  OCCUPANCY VEHICLE LANE, TO
    9  UTILIZE SUCH LANE TWENTY-FOUR HOURS PER DAY, SEVEN DAYS  PER  WEEK.  THE
   10  DEPARTMENT  SHALL  OPEN AND MAINTAIN SUCH LANE DURING THE TIME SPECIFIED
   11  HEREIN, EXCEPTING ONLY FOR EMERGENCIES, NECESSARY ROAD WORK AND REPAIRS.
   12    S 2. This act shall take effect immediately.
