MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to direct the New York state office of parks, recreation and historic preservation to allow Nik Wallenda to traverse the Niagara River Gorge on a high wire; and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. (a) Notwithstanding any provision of law, rule or regu- 2 lation to the contrary, the New York state office of parks, recreation 3 and historic preservation shall promulgate rules and regulations to 4 allow Nik Wallenda to traverse the Niagara River Gorge on a high wire. 5 (b) Such rules and regulations shall ensure that, (i) after consulta- 6 tion with Mr. Wallenda and/or his representatives, an appropriate date 7 and time is selected before the expiration of this act, and (ii) that 8 reasonable safety precautions are put in place. 9 (c) Mr. Wallenda shall pay any and all costs associated with the 10 installation of safety equipment, and also reasonable costs associated 11 with increased security or police requirements stemming from this activ- 12 ity. 13 (d) Mr. Wallenda, as well as any member of his crew or staff and those 14 of his associates or representatives, that may, as a result of their 15 involvement with the actions authorized by this act, expose themselves 16 to a risk of physical injury, shall agree to indemnify the State of New 17 York against any claim of liability for any injury or death that may 18 occur. 19 S 2. This act shall take effect immediately and shall expire and be 20 deemed repealed on August 30, 2012.
