This act shall be known and may be cited as the "Shepherd 2 Patterson law". 3 § 2. Section 305 of the education law is amended by adding a new 4 subdivision 60 to read as follows: 5 60. a. Beginning in the two thousand twenty-three--two thousand twen- 6 ty-four school year, the commissioner shall direct the board of educa- 7 tion or trustees, as defined in section two of this chapter, of every 8 school district within the state, however created, and the chancellor of 9 the city school district of the city of New York to create a document 10 giving notice to parents and guardians of school age students who are 11 diagnosed with a life-threatening medical condition or a medical condi- 12 tion that may cause a disability. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD03447-10-2S. 4150--D 2 1 b. Such document shall include a statement in substantially the 2 following form: "If you find yourself in a situation where your child is 3 diagnosed with a life-threatening illness or a medical condition that 4 may cause a disability, your child may be eligible for a personalized 5 education plan. We encourage you to reach out to our school nurse, our 6 school social worker or your child's guidance counselor. Besides compil- 7 ing a plan, there are many benefits to sharing medical information with 8 school personnel, as it has life-saving potential should a medical emer- 9 gency occur." 10 c. Each school district shall include such statement in their hand- 11 book, and each school district shall also provide this document to the 12 parents or guardians as follows: 13 (i) upon the initial registration of any student within every school 14 district; 15 (ii) at the beginning of each school year; and 16 (iii) additionally, at the time a student has been excused absent, 17 tardy or early departure a combined total of ten times. 18 § 3. This act shall take effect immediately. Effective immediately, 19 the addition, amendment and/or repeal of any rule or regulation neces- 20 sary for the implementation of this act on its effective date are 21 authorized to be made and completed on or before such effective date.
