       Introduced  by Sen. STAVISKY -- read twice and ordered printed, and when
         printed to be committed to the Committee  on  Consumer  Protection  --
         recommitted to the Committee on Consumer Protection in accordance with
         Senate  Rule  6, sec. 8 -- committee discharged, bill amended, ordered
         reprinted as amended and recommitted to said committee
       AN ACT to amend the general business  law,  in  relation  to  preventing
         rental car companies from imposing certain charges on customers' cred-
         it cards
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 391-l of the general business law, as  redesignated
    2  by  chapter 694 of the laws of 1995, is amended by adding a new subdivi-
    3  sion 4 to read as follows:
    4    4. IT SHALL BE UNLAWFUL FOR ANY PERSON, FIRM, PARTNERSHIP, ASSOCIATION
    5  OR CORPORATION ENGAGED IN THE BUSINESS OF  RENTING  MOTOR  VEHICLES  AND
    6  ACCEPTING  CREDIT  OR DEBIT CARDS FOR PAYMENT OF SUCH RENTAL TO PROCESS,
    7  OR CAUSE TO BE PROCESSED, A BLOCK, PRIOR TO FINAL PAYMENT, ON THE CREDIT
    8  OR DEBIT CARD OF ANY PERSON RENTING A MOTOR VEHICLE  UNLESS  THE  AMOUNT
    9  AND  DURATION OF THE BLOCK IS DISCLOSED TO THE CONSUMER. FOR PURPOSES OF
   10  THIS SUBDIVISION, "BLOCK" SHALL MEAN A TEMPORARY DEBIT, HOLD, RESERVE OR
   11  WITHDRAWAL FROM A LINE OF CREDIT OR AN ACCOUNT ON DEPOSIT AT A FINANCIAL
   12  INSTITUTION.
   13    S 2. This act shall take effect immediately.
