Bill Title: Directs the public service commission to promulgate rules and regulations requiring vine trimming, in addition to other maintenance procedures, for the maintenance of utility poles by the utility company or cable television company that owns such utility pole where such vine growth is likely to disrupt safe and reliable service.

STATE OF NEW YORK ________________________________________________________________________ 2988 2023-2024 Regular Sessions IN SENATE January 26, 2023 ___________ Introduced by Sen. HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law, in relation to requiring vine trimming for the maintenance of utility poles The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public service law is amended by adding a new section 2 119-d to read as follows: 3 § 119-d. Maintenance of utility poles. The commission shall require, 4 in addition to other maintenance procedures, the trimming of vines on 5 utility poles throughout the state by the utility company or cable tele- 6 vision company that owns such utility pole. 7 § 2. This act shall take effect on the thirtieth day after it shall 8 have become a law. Effective immediately, the addition, amendment and/or 9 repeal of any rule or regulation necessary for the implementation of 10 this act on its effective date are authorized to be made and completed 11 on or before such effective date.
